Just got off the phone with the IRS and they said that our request for an ITIN was rejected because the tax return wasn't included (though I did send it) and the W7 is missing my SSN. That was after waiting more 13 weeks.

 

We are still waiting for our NOA2, which I think should  come at anytime.  I can resubmit the paperwork and, according to the IRS, it should be 7 weeks before receiving a decision on an ITIN. In sum, this is holding us up from filing our taxes. Because of this, we may or may not have a tax transcript when it comes time to file the Affidavit of Support. 

 

Filing this way is also costing us our Earned Income Credit, which means we would receive very little compared to what we could receive if I file single. This option would be the only certain way to have our tax transcript (as I could easily file electronically). But I'm afraid it could raise questions during the interview (though I could include a letter where they rejected our ITIN). If I go ahead and file single, we could still simultaneously file for the ITIN (and include proof).

 

My questions are:

1. How much would filing as single impact our case?

2. Is a tax transcript for this year absolutely necessary for the Affidavit of Support? (Or can I include other supporting documents including W2s, letter from my employer,  and etc?)

 

A friend of mine filed single while in process and said the interviewer raised no concerns at all. 

 

I'm at a loss. Please help.

Single is not a valid filing status if you are married. You can file MFS instead.

A transcript is not required. You can provide the 1040 + all W-2s/1099s/etc.

A letter from your employer + pay stubs is suggested to be provided anyway.

1.  I agree that you can file "Married Filing Separately".  You can amend later.

2.  Submit 1040 and associated documents.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

No.  To file "Married Filing Separately", You list your spouse's name in the appropriate field, write "NRA" in the SSN field, and then mail via USPS.......

Does she have to have an ITIN? Will they process the return without it?

For MFJ, she needs an SSN or ITIN. For MFS, you can write "NRA" as noted above. See https://www.irs.gov/pub/irs-pdf/i1040gi.pdf

Filing single does not effect your case. 

 

transcripts are not necessary. I submitted W2, Tax returns, Pay stubs , letter from HR and Social security statement.
