Hey everyone                 
I had my interview in Lagos Nigeria on the 21/06/2018 and CO was Refusal to issue the visa the CO was asking me are you married before I said yes.because I apply for non immigrant visa before and I was Refuse in that application I was married to my Ex-wife then but he was a traditional married is not Legally married to me. and my lawyer told me that I should tell the CO that is traditional married is not Legally married to me. and I told the CO that I return her bride price that what we do to divorce in our culture. and CO said I’m still married to her so she said  I didn't show nothing to her show that we are not together no more. Know Divorce from me to show I’m not married to her know more. and CO said she going to send my application back to NVC to revoke my application.that what the CO said and I don’t know what to do now and my US citizen wife she known everything about it .and the CO she don’t even give me 221(g) for refusal She just give me one White paper saying my application will be sent back to NVC. Please help Thanks

You made a big mistake. As long as you applied for visa before and they have your information as you been married before you should have done a divorce and have it finalized before getting married to your current wife. Now they see you as been married to 2 women. Traditional marriage is still Marriage when it comes to Immigration issues. Now you need to get your self a lawyer and go do a divorce for your previous marriage but then talk to an licensed Immigration lawyer he will help you.

I know is a big time mistake is our lawyer over there saying I don’t need it because is traditional marriage is not legally married to me will get a lawyer to do the divorce I want to ask can do traditional marriage divorce in court Thanks

Did they gave you any certificate when you guys did the Marriage. And also the lawyer that gave you that advise was he from U.S or Nigeria?

When you where filling the petition from the state did you put married before? Well I have no idea how you will prove to them about your marriage been traditional I guess you should do some research or talk to a lawyer in Nigeria as well on how to show divorce documents on traditional marriage

Let's make sure we are clear please verify the above...

You conducted a 'traditional' non-legally binding marriage and then listed on a previous application for a non-immigrant visa (presumably a tourist visa) that you were married at the time.  Now your legal wife a USC is petitioning you to come to the USA.   However, you were denied because you previously listed on your previous application that you were married and failed to provide any proof that the marriage either never legally existed or was legally dissolved.   If all of this is try then you'll likely need help from a US immigration lawyer to figure out what your next step is in terms of your application and need help from a Nigerian lawyer to obtain some type of legal document that shows you were not previously legally married or that your previous 'traditional' marriage has either been annulled, or dissolved.

No I didn’t put married there because my lawyer said know. Yes I just talk to a lawyer now he said I should come and see him tomorrow. thank you so much for the help

Yes my lawyer was conducted traditional is not legally married to me he say because is not a court marriage I think is my lawyer fault that he told my wife in U.S and I told my wife to get new immigration lawyer for the next step and I just called a lawyer in Nigeria for the divorce he say I should come and see him tomorrow thank you so much for the help

Do not pay the lawyer another red cent. If you are going to see him/her tomorrow do not be afraid to express your disappointment in the erroneous advice that was given to you. Your previous marriage is now seen as legit and the burden is now on you to prove that it is legally over. This has cost you time and money but fortunately there is still a way to resolve this. You will need to seek someone who has experience dealing with Nigerian cultures and divorce from tradition weddings. After the previous wedding issue has been resolved you can reapply for a spousal visa with your current spouse.

Sorry that this happened to you but your only recourse is to get a better immigration attorney who is versed in your Nigerian culture. The word 'marriage' is what the officer focused on - whether traditional or court - which is what caused the denial. You and your traditionally marriage-bound spouse should have done a sworn affidavit indicating that the marriage was dissolved and no longer valid.

  There is  a case where immigration accepts  a traditional ending of a traditional marriage.  I need to find it again.   But you will have to provide both the case and proof that you meet the standards that case cited.  

This will not be over quickly. You will not enjoy this.
