hi,

 

My wife took temporary restraining order against me almost one and half month ago. I came to my country for some family issue for four months and i told judge about it and she gave next hearing after 4 months. Now i am in my home country and in no contact with my kids and wife.

I have a lease agreement under my name for 12 months which completes in November but at the time of agreement we agreed that i can terminate lease if i want at one month notice. I gave him notice in may that june is the last month. But my wife took restraining order against me in may and continue lives there with kids. My landlord used one month security as a rent for the month of June. Now in July, i have not paid him any money but my wife is insisting on staying until landlord provide her eviction letter. My landlord is asking me to pay rent otherwise he will ruin my credit. What should i do. i am living abroad emotionally disturb with no income. 

 

what should i do. i am insisting landlord that i can pay him half rent until he gets eviction letter. Please tell me what should i do. (My wife is house wife with no income but she can go to her parents until this restraining order).

At this point I would advise to consult a divorce attorney and ask for guidance, maybe they can offer you some guidance.

Well, as you are still married to her I doubt there's not much you can do as in getting her out of the apartment. Most, if not all, states don't allow for you to kick out your spouse/partner/family however you want. I would suggest divorcing her and ask a lawyer for advice on getting her out of there.
