Have you downloaded and read the Instructions for this form.. it is realyy helpful.. you will find it on the USCIS website..

Read through it and I am sure that you will get the information .. it is pretty clear.. long but clear..

No it is not that clear unfortunately, that's why I asked.

It says:

"Item Numbers 23.a. - 25. Federal Income Tax Return Information. You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years."

I understand that I need to attach both her and my tax forms. But there is a box to fill in the income. Should I only fill in her income or add both income? The form use "you/your" (which is the petitioner/my wife) and not "household".

Wondering if anyone has gone through the same problem.

Item 2

Please read the instructions.. as I have just done...

regarding part 6

Her annual income is declared in q7

You are listed in q8 and your income stated q10

Your joint income is listed in q20

Item 26 is her income only

You complete a separate I 864a as indicated in q 21

You are a PhD  you can do research !!!! ... You can confirm all this by reading the instructions.. you should read the instructions and confirm what I have said..  please do ! 😎

Well form filling is my worst enemy.

Not sure what form you're talking about, but there is no item 26 in part 6 of i864. And I don't think I need to file I864A because I should check box number 22 instead of 21.

I apologise  for my short reply before..

Her tax transcripts and documents are attached to her I864. Yours are attached to your I864a.

One of the issues with filling out the forms is remembering who the form is actually for... this form is for the petitioner.. your wife, not you.. therefore everything should be read with that in mind.. unless it states things like joint or combined, it is directed at the single person who is the sponsor..

Yes I have been through this process.. twice.. yes I have completed the I864 znd i864a forms for two applications.. yes recent experience.. yes I have been successful both times,  with no RFE.

Alright, so what did you fill in these boxes? Both of you and your sponsor's income or only your spouse?

I interpret MY as single.. therefore HER income alone.

Household income is lister at q 20

Fair enough, thanks.

I'm just wondering if they will look at those numbers alone and not bother combing through both my and her tax forms. Because we really have to combine both of our incomes to overcome the 125% threshold

We've been planning for this for quite a long time already. :(

For the tax return questions, this is to be listed exactly as stated on the tax returns. If the OP filed jointly, they would list the joint income as stated on the tax returns. If filed separately, then this would be their individual income on their own return.

Problem is there is only one box to fill this number in. And we didn't file joint tax because we were not married last year.

That's why I'm so confused.

So now the question is still left unanswered: should I add the income of both of us and put in to the box 24a (if we filed tax return separately last year) or just my wife?
