Hello all,

I am a Canadian marrying a US citizen, we are not doing the K1 but applying for spousal sponsorship once we have wed. My immigration attorney mentioned to me that "with a well put together application, the interviews are being done away with" and I likely wouldn't have to do one. Has anyone else bypassed the interview stage?

I think you misunderstood your attorney.  There is no plan to eliminate Spousal Visa interviews. In fact, it makes no sense at all.  Perhaps he was speaking of the Removal of Conditions interview for 2 year conditional Green cards.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

One more thing:  The interview is one of the most valuable tools for the Consulate (the agency which actually is responsible for issuing visas) to evaluate the applicant.  It is an integral part of the process.

I don't think she was referring to that, I was asking where the medical and interview would take place. SHe told me that the medical can be in either country (if I decide to wait out the process in the US she would give me a list of approved facilities that do the medical) but that nowadays they are getting away from doing the interview with well put together application packages. She didn't mention anything about the 2 year conditional card

If you're going with spouse visa your medical and interview will be in your country. 

 

If you're married less than 2 years you will only receive a 2 years green cars which you'll need to remove conditions on after 2 years. That's a whole separate process.

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

I don't mean to sound rude, but this is the most outlandish "advice" I have ever seen attributed to an "attorney" on VJ........

If you are Canadian and  living in Canada then the spouse visa interview will be at the US embassy in your country. If your attorney told you that you will bypass the interview then dump this attorney.

I think I just figured this out..........It sounds like your attorney is suggesting that you commit visa fraud, and it can result in very severe consequences.....Dump that attorney today...

Most (if not all) attorneys love to suggest "alternative" routes and sadly a lot of people follow that advise thinking they can fool the system. When all what they are doing is buying themselves troubles for the future.

Your lawyer is incorrect (I would question how many US immigration files they really have), in about a year after you submit your application, you will need to go to Montreal for your interview  as it is the only location in Canada conducting K1/Cr1/IR1 interviews.  You will need to do a medical 1-2 weeks before your interview with an approved doctor which you can only do in either Vancouver, Toronto or Montreal.

 

CR1 visas are pretty straight forward to do on your own, and you have lots of help from the Visajourney family.
