Is there really any benefit to filing K3

Recently, it does not seem that there is much of a benefit of filing for K3 compared to IR1/CR1. Firstly it seem that the people who file both I130 and I129F have to wait longer for their approval compare to people who only file I130. Secondly, the service centers seem to holding I129F longer even after approval. There are people on this forum who got approved over three weeks ago and the NVC still hasn't received the case. For the I130, there does not seem to be this type of delay. Thirdly, USCIS seem to have a big problem sending NOA1 for the I130 and many people wait for it for too long since they believe that it is required to file I129F.

I also waited for too long and now my 129F is still sitting at CSC. My I130 has been approved for about three weeks and is at the NVC. It seems that I wasted my money filing for I129F since it was not going to do me any good. And further I am worried that by filing for I129F I may have to go through K3 process and still have to worry about adjusting status. This whole thing is a complete mess!!

Jan. 15, 2007 - Got married in India

Feb. 02, 2007 - Sent Form I-130 via Certified mail

Feb. 05, 2007 - NSC Receives Form I-130

Feb 07, 2007 - NOA-1

Mar. 15, 2007 - Touched

April. 11, 2007 - Touched

April 17, 2007- Approved!!

May 01, 2007- Touched

NVC Processing of I-130

April 27, 2007- Received by NVC

May 14, 2007- IV Bill and AOS fee bill Generated

May 22, 2007- Sent AOS fee bill

May 27, 2007- Received AOS fee bill in mail

June 11, 2007- Received I-864 package in mail

June 14, 2007- Still no IV bill. Called NVC so that they can resend it.

June 18, 2007- Sent completed I-864 package

June 22, 2007- Still no IV bill

June 25, 2007- Finally Received and Paid the IV bill!!

August 05, 2007- Sent DS-230

August 21, 2007- Case Completed at NVC

August 27, 2007- Case Forwarded to Embassy

October 15, 2007- Interview!! Visa approved!!

October 18, 2007- Visa in hand

October 27, 2007- US arrival!!

You need to be more thankful. Take a breath, read some posts of people who have been waiting a lot longer for approval, and then really look at your situation - seems pretty good to me.

03/01/07 Mailed I-130 priority post to Nebraska.

06/19/07 Approved!!!

07/10/07 NVC assigned case #.

10/25/07 NVC Case Complete!!!!

01/22/08 Original Monreal interview- requested to reschedule, told 3-4 month wait.

04/17/08 Interview in Montreal

04/21/08 Received VISA package

06/24/08 Crossed border

07/26/08 Received conditional greencard

07/28/08 Received SSN in mail (went down and applied in person 07/14/08)

08/11/08 Infopass appointment to request 10yr greencard instead of conditional. Mailed out 1-90 with support.

09/25/08 Received case # for I-90

02/17/09 Received 10yr greencard!!! WOOHOO

I was bummed about not being able to file for a K-3 visa since I didn't have the NOA1 for the I-130, but now that I think about it, it was a better choice for us. Our petition was approved in less than 90 days and hopefully we'll get an interview in September, which will be about 7 months total from the time we filed till we get the visa. I don't think that's a bad deal at all, so yeah, we're glad we ended up waiting for a CR-1 visa.

05/10/07 - NVC receives petition, case # assigned

08/08/07 - Case Complete

09/27/07 - Interview, visa granted

10/02/07 - POE

11/16/07 - Received green card and Welcome to America letter in the mail

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Certainly there is not as much time-saving benefit to the K3 visa today as there was a few years ago when the category was created. But it can still save a meaningful amount of time for many people.

You got your NOA2 already???

Well I filed late January and the case arrived at the embassy a couple of weeks ago. That wouldn't have happened without the K3. To me a few more months sitting at NVC is a lifetime since, going through Egypt we will have to wait at least 4 months on security checks. I guess if we had a chance of getting a visa shortly after the interview I'd think twice because of the hassle he'll go through once he gets here doing aos but since we will have to wait so long after the interview it's a good solution for people like us.

12/28/06 - got married :)

02/05/07 - I-130 NOA1

02/21/07 - I-129 NOA1

04/09/07 - I-130 and I-129F approval email sent!!!!

04/26/07 - Packet 3 received

06/16/07 - Medical Examination

06/26/07 - Packet 3 SUBMITTED FINALLY!!!!

07/07/07 - Received pkt 4

07/22/07 - interview consular never bothered to show up for work.

07/29/07 - interview.
