Timeline

Hi,

This is my first time posting on here, I received my case number yesterday and went on ceac to track it and it says it is at NVC and to follow the six steps to take before scheduling the visa interview. Does this mean the i-134f and the other documents from my fiancee? Or is this something completely different that must be sent to NVC? I thought after I got the case number they send it to the embassy and then we get all the documents for them. thanks

I received an RFE dated January 10th. It was a letter asking me to answer yes or no to a question about my criminal background, arrests, etc (which my answer is no), and to sign, print, and send back the letter.

 

Is it common to receive such an RFE? The letter didn't request any additional documentation proof of anything else regarding our relationship. Also, I would have thought such an RFE would have been sent earlier in the process since we have been waiting for the NOA2 for 6 months. I thought a background check was part of that long wait.

 

This seems to cause such an unnecessary delay for us 😞

They process all the documents to include background checks and when EVERYTHING is return then the agent will adjudicate your case on the findings. Any discrepancies found whether missed checked boxes in the I129f or something in the back ground check is sent out in an RFE. They do not want to be sending out multiple RFE's as that drives them nuts and you to.

 

In your mind you should revisit ANY arrests whether in teenage years or as an adult or even those that were expunged. This happened to another couple @John & Rose. They faced a very innocent situation where this same RFE came to them. John innocently thought that a expunged case from his youth that was "forever sealed" would not turn up in a background check. He check NO and was denied their K-1 as it showed up in a background check. They are now married and pursuing a CR-1.

 

Of course your mileage will vary.

In my case it was a 30 year old misdemeanor that was dropped and later expunged.  No court date but the arrest stays on the record.  There are no public records available since I had my arrest expunged.  We were denied because I answered no to question 4a.  If you have ever been cited, arrested, etc...even a traffic ticket where the fine was over $500 you should answer YES.  The actual arrest didn't impact my petition.  It was the fact that I did not disclose the arrest that caused our denial.  If they sent that it was for a reason.  Be careful.

 

It may just be that you forgot to check the "no" box.  that is an easy fix.  Do it and send it back ASAP.  I've seen approvals within a couple weeks of a successful response.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

The question is in the petition.  The DS-160 is the actual visa application and most information in that is for the beneficiary.  The question I am talking about is in the I-129f form.  If you received an RFE it is for the I-129f.

Is it possible to call them and ask what the RFE is for? So we can look into it without waiting for the mail?

Yes that was me. Call USCIS. Tell them you would like a copy faxed to you on the RFE because you are on a deadline that can’t be extended. A tier 2 is the only one that has access to those systems. They can also read it to you (most will do this but some don't) and let you know what they are requesting.

now you got me worried, i had completely forgotten about something like this when i filled out my form, both sites are showing still received, and i have not gotten anything in the mail, so I am contacting USCIS to see if i can amend it with the information. like yours, mine was a misdemeanor and it was dismissed, no court date or anything, and it was 26 years ago. i hope i can fix it before they actually work it.

I suggest getting as much information together for the interview as possible. USCIS will approve the petition if you prove you met and are capable of marriage. They don’t care about the arrest. It will make it to the interview. I would bring it to the CO’s attention there. Don’t ignore it. It may come back to bite you in AP. They congratulated my now wife and took her passport. Two days later she got her passport back with the denial. Let the CO know it was just an honest mistake and you should be fine. It is about the disclosure, not the arrest.

wow thats messed up how they did that. your post is what reminded me of it, so if we make it through ok, then i have you to thank for it.

 

i told my fiancee already and i am also hoping that my contact and reference number with USCIS (i always try to send emails or get things in writing to verify), and if they send an rfe i already know how to get the information if needed, although i sent them the docket number, when it was dismissed and as much information as i could find in the correspondence i sent to request to have it amended.

They won’t send an RFE because they do not need to ask for additional information if the question was answered “no”. They also don’t really care because their task is only to determine if you are eligible.
