pretty hard to fight an issue when they say something like your husband did not know / how do u prove he does if he did not know

i would forget fighting the Noir and refile as it is a lengthy process (just my opinion)

my appeal (and other peoples respones to NOIR) are taking  over a year/ i won it and proved a bona fida marriage as the court made a decision but they advised to reapply

if it was me, i would reapply and make sure he knew answers to all these issues at next interview (still just my opinion and not legal advice)

Is he from Ghana. I mean your spouse and how many time have you been to his country so far. Well you need to put more evidence together and send it to the USCIS. Like more pictures, chat, calls, video call screenshot shots.  And the pictures should be pictures taken aith family and friends after the interview was deny show them more evidence they will send the petition back to the embassy but make.sure you do things right by front loading send in all evidence you have. But I want to know how many times you been to his country and after the interview was deny did you met in person again if yes how many time.?

HI,

I'm really sorry you and your spouse had to endure this.

I suggest (like others have done) getting an attorney or get one who consults on immigration. If the 5 items they listed in the letter was incorrect, then you have the chance of an appeal.

Best of luck to you and yours.

Loathe to be specific when so little is known but that was my thought.

I think if you re-file, you will just face the same issues. If your case is re-affirmed by USCIS the embassy usually will not reject the petition again for the same reason as USCIS was satisfied. Thus, I would not refile.

I personally would not recommend refiling unless the appeal doesn’t work. There have been quite a few people denied at the Ghana embassy recently, who appealed and won their cases. It should only take a month or two to get an answer after you submit evidence, where refiling will take 12-18 month.

You need to get an Attorney this is crazy you guys even have kids and they deny him. Makes no sense you have to involve an immigration lawyer.

It has happened to us the same , mostly what I was asked wasn't what it was written to USCIS.

Pls you can do it without a lawyer involved , just gather all evidence , I meant everything from the date you fill ,communication , letters , cards ,chats ,photos , affidavit from both families , affidavits from friends , bills , visits receipts, flight boarding pass , write a biography about your marriage and let the USCIS know how much you care for each other , everything you knows that have attached your married, gathered it and submit it within 30 days.

Don't waist time , a lawyer will keep on telling you story always about money .

Good Luck .
