Hello fellow members please I need help I waited close to one year 3 months to hear from USCIS since the embassy set my case back this is what I received in the mail today can anyone advise me on what to do or how to go about it by the way these statements are not true at all these were simple questions that could have been but we're not ask except for why my family did not attend but my husband explain to them but the other question was never even asked he was only ask 3 questionsm

1 the beneficiary had difficulties explaining how he proposed to petitioner 

 

2 the beneficiary was unable to provide information about the wedding reception or wedding planning

 

3 the beneficiary say that you and the beneficiary attendance 6 months of marriage counseling but he was unable to provide information about the counseling

 

4 the beneficiary did not provide a reason for why your family and friends when able to attend your wedding

 

5 the beneficiary was unable to provide any substantial details about your life in the US with relating to friends work colleagues Hobbies or employment

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

All you can do is to construct a carefully worded response.......was your husband extremely nervous? In what language was the interview conducted?

Personally, I would seek legal help...........these NOIRs are serious business...others might disagree.  You are looking at a long battle.

Also did you go with him to the embassy?? If all you know about the interview is what he told you, keep in mind that you only have his perspective of the interview. What were the three questions he was asked?

Conducted in english I dont know if he was nervous leave it tl him he would say he wasnt but i would say he was he has a problem with talking up to defend him self against people he think i powerful i dont have that issue at all

Hmm well I would also suggest talking with a lawyer to best advise you on how to move forward.

You need  somebody to review the totality of your case. Can you move, might be the best quickest solution.

Our letter wasn't completely accurate but each point was something that happened during the interview.  One item was something an officer said to my husband but in the NOIR they said it was my husband words.  In addition it was worded to seem worse of then it really was but it wasn't that far off.  I was at the interview but even afterwards my husband and I talked many times and documented the entire interview so it was pretty easy for to write a reply.   I had my husband include a statement as well to cover what he did say.  Not sure if it is successful yet as we are still waiting for USCIS to review but we pray togheter everyday over it and hoping for a positive response.  

 

I would recommend at least getting a consultation with a lawyer.  If he doesn't recall those questions I'm not sure how to rebut.  Too many questions don't match your husbands notes and writing a statement for each one might not be enough to satisfy them.

I am sorry you got this, but in a way it’s a good thing because now you know exactly why the embassy denied you and you can overcome it. 

 

There are two options. If you feel comfortable writing a rebuttal and collecting all the evidence needed, you can do it on your own. If you don’t, I would recommend getting an attorney. I know several who did it on their own and were reaffirmed. I also know someone who used an attorney and was reaffirmed. Do whatever you feel is best for your case.

 

If you choose to proceed on your own, you want to provide evidence and statements to overcome each point individually. You want to go point by point. Look through old chats, get letters of support, anything to show the claims are false. 

 

For example point #4, you should write an explanation about why family didn’t attend (too much money, couldn’t get time off work, unable to travel because of health reasons, etc), whatever the reason. Then provide letters from key family members. The letters should talk about their support of your relationship and why they couldn’t attend. 

 

You should do do something similar for each point, as well as include all evidence to show a strong, ongoing relationship. Trip evidence, financial stuff, calls, chats, etc.
