I would think that police reports, records of staying in a shelter, and one report from one professional would be more than enough.  Couple that with the normal things that were NOT done (joint finances, etc) and it builds a pretty clear picture of the situation.

You are certainly legally allowed to go to your home country, but of you will not be able to re-enter the U.S. afterwards without permission.

 

Do you have any family or support system in your home country?

Of course she is allowed to go back to her country, but when she says that she can't, she means that she doesn't want to.

 

I think she's leaning towards abuse claims over a regular divorce waiver is that somebody probably schooled her that it would be easiest and fastest.  And she doesn't have much proof of bona fide marriage.  She pretty much admitted in her previous post that she looking for fastest to become USC.

 

And to add, in a lot of these cases it seems that anything that the USC spouse says no to, they consider abuse.

The fact that you are depressed now could easily be attributed to the divorce itself, and that is a common result of divorcing---or so an opposing attorney would argue. And the fact that you are not seeing a psychiatrist? Does that mean you're not taking any meds for the depression? Sounds like the depression is not severe--or so an opposing attorney would argue. Your ex could conceivably sue you for defamation if the abuse could not be proven.

 

Your assumption is wrong, to file the I-751 based on extreme cruelty the  abuse doesn't need to be mentioned in the divorce decree.The depression doesn't have to be major depression, it's not mandatory to take  medication to have the I-751 waiver approved either.

Ask the psychologist to mention your background,onset of problems, abuse in detail, tests administered and results,  treatement plan and referral, if needed. Ask to have the test BAI, BDI  and PTSI done, please tell the professional that you don't need tests such as TAT,PAC,TAI.
