Hi. I am a naturalized american citizen and my mother is a legal US resident. I have 5 other siblings here in the US who are all nurses and are all american citizens as well. My question is: I have a 44 year old sister in the Philippines who has mental disability.  We want to bring her over here in the US for short visits (3 months at a time) under a tourist/ visitors visa. What documents do we need to present? Obviously she doesn't own a home, does not work and just basically depend on us for financial support.  We don't have plans of having her live here in the US as she is well taken care of by our relatives in the Philippines.  We just want her to be able to celebrate Christmas, her birthday and some other special occasion with us. Is there a special visa for people with disabilities who will just come to the US for a visit? Would greatly appreciate any information that might help us.

With the mother and all siblings in the US, her getting a visa is very slim but who knows there may be a luck, doesn’t hurt to try. There are no documents to bring since she doesn’t have anything to show ties to the country. Assumed-to-be taken care by mother n siblings will definitely overshadow the being taken care well by relatives.

 

Just apply and hope for the best. Good luck.

Here is what your sister's situation would look like to a CO.

 

If granted a US visitor visa, your sister would come to stay in the US to be taken care of by her LPR mother.  Her siblings who are nurses would contribute to her care.  You have stated that she does not work and requires care as well as financial support from her family  Then, instead of her family caring for her, her family will send her back home to be taken care of by relatives.  Yeah, I don't think they will buy her going back to be taken care of by relatives.

I agree.  It sounds weird that the whole family including the mother is leaving a mentally challenged sister behind. 

 

You could apply and see what happens.

Why bring the mother to the US as an LPR if the sister needs care?  

 

This looks like a classic case of bring the mother first, then we figure out how to bring the sister.  If she gets a visitor visa, then she can come to visit so the family can figure out a way for her to stay while mom takes care of her.

This is the biggest hurdle to getting the sister a visitor visa.  A visitor visa would be a short cut to petitioning a 44 years old mentally disable woman from the Philippines who would have to wait decades for her USC siblings to petition her.

 

Has your LPR mother filed an I-130 for your sister?  Does your sister have a pending I-130?

Couple of things come to mind:

 

Can she get Travel Insurance?

 

Can she travel by herself?

She can worry about trip planning after she gets the visa.  No visa, then these issues disappear.

The OP should worry about the lack of strong ties to the PI and the strong ties to the US.  Her sister is unlikely to overcome the presumption she intends to illegally immigrate.

Easy to get answers to those questions at no cost, visa applications cost and take time.

Just reading this post makes it look like you certainly want to bring her to stay for good.

 

If you can't convince a forum then a CO certainly wont be convinced she will return. Lets be honest that was never the plan.

How often do people listen to us when we tell them that there's little chance of getting a visitor visa?  

People will apply and take their chances regardless of what we say.  Just letting the OP know the challenges.  

I get where you're coming from.  There are multiple hurdles for the OP's sister.

Flip the circumstance.. let's say mother applying for the B2, claims strong ties to home because of a mentally disabled daughter whom she claims she'd return to take care of (as many b2 applicants claim). Ergo, having a dependent close relation at home overseas is no tie to that home. 

 

6 USC siblings, 1 LPR mother 

 

Imagine the CO thinking:

Why did the siblings/mother abandon their remaining sister?

What are the odds siblings and mother would put their mentally disabled close relative on a plane back to Manilla?
