Hi all

 

Please please don't hate or judge  me for this post, but as the saying goes "don't ask you don't get"

 

My current situation is my petition is on route to the DOS it was sent 28yh July, you would think great hey! Oh no not me it's an awful time I am looking to get my marriage annulled as my husband basically frauded me into marriage, let's just say he is not the guy I fell in love with and he shattered my hopes and dreams of starting a life in the usa and pursuing my career, so please no hatred reply I am already distraught. 

 

I do not want to enter the usa with this visa as i would live a very un happy life, the question I would like to ask which will prob be no but here goes. 

 

As my petition has been approved and on route to DOS NVC stage, is there a way I can transfer this visa into something else for me to carry on my life in the usa or even petition to them by myself to change the visa? Or is it a long shot and it's a big fat NO! And I have to now start again and research another route to pursue my life dream and coach ice skating some other way? I just don't think a H visa will work and I have no other idea what to do. Can you hire a lawyer and apply for a green card your self? 

 

Again I'm sorry for the silly question asked but I am just trying to make sense of it all and I'm so frustrated to see my petition approved and I can't celebrate it at all.

No you can’t convert a marriage based visa to another. You would fail when they discovered your issue at the interview.

The petition is for a spousal visa. There's no way to change that to another visa category.

Divorce (or annul) and move on.

There's no basis for a green card for you at this time, so nothing a lawyer can do.

If you can find a suitable employer to petition you for a new visa, then you will be able to pursue that. You can look at other work and investment visas as well.

No marriage, no visa.  It's that simple.

 

There is no conversion.  

 

Without a bona fide marriage, this road is closed.  You can pursue other paths.

 

For a work visa, you need to find a willing employer who will pay and go through the visa process.

 

You can not self-petition to immigrate to the US.  If it was this simple, there would be billions of people doing this.

 

Divorce and move on with your life.

No.

There is no legal basis for you to get a green card, so a lawyer won't be able to anything.

If it's essential for you to do this within the USA instead of pursuing the same kind of dream in the UK, then you'll need to find a US employer willing to sponsor you for a work visa (as well as fit the criteria for obtaining a work visa).

Nothing stops you from pursuing your career in UK. Or other European countries. Pretty sure Scandinavian countries could be a good start for this kind of career.

Why does it have to be in the US? Honestly the way your post sound is that the only thing mattered to you was to get to the US and work there, relationship was somewhere on the second place.

 

Anyway. No, you can't apply for green card by yourself. You can't apply for work visa by yourself. Also somewhat doubtful that you qualify for work visa.

Your spouse visa is gone at this point.

It's a big, FAT no!!   The only thing that was approved was your relationship to your husband...nothing more........Your husband's petition was approved, while you have had nothing approved.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thanks for your comments, I don't appreciate saying my relationship came second, as I am the one ending the marriage not him. He is mentally sick and I don't want to come to the usa for that, I can pursue my career anywhere but why can't I say the usa? What's wrong with  that. I dont need a marriage to do that 

 

I am going through enough ####### right now for comments like that. Its just not ok, I have been to the usa for many years now and grown to love it and the sport thrives there

 

I only wanted to put my question out there to see no harm, I have moved on I was just curious.

Please don't take this the wrong way but quite frankly it is frustrating to find that a couple who isn't serious about marriage received the NOA2 in a reasonably short time while other married couples who are bona fide and having to endure much longer waits. Sorry if it sounds like a rant but my opinion is that you should stay in the UK and move on with your life.

Without touching on the rest of this post....best option for you right now is a work visa, if you are able to find an employer willing to sponsor you.

You want to come to the US.  Lots of people want to come to the US, but can't.

 

You can pursue your career anywhere where it's legal for you to do so.  You can not pursue it in the US because you are not legal to work here.  Currently, you have no path to immigrate here.  That's what wrong - you are not entitled or have the right to pursue a career here in the US.

 

You came here for advice.  Sorry that you don't like the answers.  

 

It doesn't seem like you have moved on.  You are still angry at your husband.  Angry that he screwed up your immigration to the US to pursue your career.  

 

It doesn't matter how many years you have been to the US and that you have grown to love it and the sport thrives here.  None of that is relevant except to show your motivation to come to the US.

 

Read this thread.  What does it seems that you are most concern about?  It seems the most important thing to you is to come to the US to pursue your career.  That's the way it looks.  I am not accusing you of anything.  But look at this thread and what is your concern?  It's not your relationship.  It's all about immigrating to the US to pursue your career.
