Hi,

 

I hope someone ca. Guide me? So I got my noa2 approved last week which should be the happiest day right? Wrong! So long story short...

 

We got married in Sept 2017 and unfortunately my husband the USC Has been very un reasonable and unfaithful and to be honest I do not want to start a life with him when he is mentally ill and very dillusional. I tried to make this marriage work but he is beyond crazy, and won't admit to anything, the last time we spoke on the phone was April, and he just won't talk and blames me for saying he has been un reasonable. 

 

So can I the beneficiary withdraw my visa? And can I get an annulment? I have tried to ask for a divorce as i am not paying legal fees for his bad actions but he just goes around the question and goes on the defense 

 

Please help any advise

You can get an annulment if you meet the requirements in your Country, or get divorce according to your laws. You are not a US resident so don't even bother trying to get a US divorce, use your energy to follow the laws that have jurisdiction over you. It does not matter if he does not live there. You can still divorce/annulled with or without his consent it just may take longer. 

 

I don't think you can cancel until the petition get to the Embassy. But others will come along and let you know for sure soon enough.

Thank you, I will check the laws. I am from the UK, so my visa was approved last week out of Texas so am I unable to cancel that then? This is frustrating I do not want my name on his case anymore.  He is just sick and no one would want to live with a dillusional human being right! I wanted nothing more than yo make my marriage work but I'm glad it hasn't now

I think you mean his petition was approved, not your visa. You apply for the visa at a US Embassy after the petition gets approved and goes through the NVC process. Sounds like the petition is on its way from Texas to the NVC. So just don't apply for the visa and you're all set. :)

If the case was approbed goes to nvc and then if you comolete the process there go to the embassy, if you dont take any action it will expire at nvc

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

My case has now been moved to the department of State, say in the future I meet someone else will this affect any future cases? I do not want my current case to carry on as my husband is un stable and I don't want a un happy life. He was something he wasn't and sold himself so well and then just turned it's so frustrating when everyone waits so long for approval regarding these cases and I wish I could be happy to know my petition is on route to the DOS I'm just so angry.

Hi there I'm sorry about your current situation. First focus on getting the divorce before you think about someone else. Once it's all done you might be able to be petitioned for again but it's a long way until then. Again focus on yourself now, get the divorce and put your happiness first.

You did not make a petition. The US husband petitioned, so it's not yours to withdraw. And it is already in transition to NVC (Dept of State). You are basically done with USCIS so no point contacting them now. 

 

The NVC is where YOU apply for a visa, send documents, and pay fees. Don't apply and it dies. Once you hear from NVC that your case is actually there and they are ready for you to start your visa application, you can write them a letter saying you do not plan to apply for a visa because you are getting a divorce and are no longer eligible for a marriage based visa.

Ok thank you, will I the petitioner get the letter or will my husband get it? Because I won't know when they want the visa process to start? If I don't get it.

 

Yes I am deffo looking after myself first and thank you for yoir kind words little immigrant but pls don't be sorry I am much better now than having to live with a dillusional man. 

 

How long does it take to text the DOS and then foe the letter to arrive?

Hi 

 

I am sorry if I have filled this in the wrong category but I couldn't find one to relate, I am currently going through the CR1 process and my petition is currently on route to the DOS and I need help regarding the below, its just a short snippet of my issue

 

my husband and I got married sept 2017, he is American and I am british, we have been going through a spousal visa for me to move to the usa, I haven't spoken with him since april over the phone, I have tried to make this marriage work but he has taken a whole 360 on this and has been un reasonable behaviour, commted adultery, and in my eyes commited fraud selling me himself and not turning out to be who he claims he is, he suffers from mental illness and will not take control of his actions or admit any wrong doings, I do not want to move to the usa to be with him as I fear for my safety. I want to know if I am able to file for an annulment? he will not speak with me and blocked me, he was living with his ex in the house where I would be living while we are still married and sending emails to her saying he loves her and I have a message he wrote to a friend saying his ex has explained everything and the time away from him she has learned her lesson and I feel like I was a stop gap between  I have wasted a year of my life changed documents to married name, he even put me on his bank account and I have a card. and to now completely go off the rails is beyond belief. that is a short snippet

Criteria for annulment would likely differ from country to country. And in this case, because you and your spouse don't live together yet, I don't know how this will even proceed. So yes, best bet is to talk to a lawyer.
