Questions regarding changing my step son's last name

I am in the process of adopting my stepson too. We want to change his name on his Filipino passport before we do Removal of Conditions. I am going to actually check with the Philippine embassy if his passport can be changed by an adoption in a US court. Why wouldn't they? They allow a passport change for a fiance that gets married in the USA with USA marriage certificate. Again, I want a second opinion direct from the Philippine embassy rather than accepting one person's opinion without backup source.

Here is some information from the Philippine Consulate General in New York concerning passport renewal for those under 18 with foreign adoption:

 

If the minor applicant is undergoing or has undergone the process of foreign adoption / Inter Country Adoption Board (ICAB) adoption process

  • Personal Appearance of minor applicant and ICAB representative
  • PSA Birth Certificate/PSA Certificate of Foundling
  • Endorsement from ICAB
  • Certificate of Child Available for Adoption/Deed of Voluntary Commitment
  • Placement Authority issued by ICAB
  • Certificate for Issuance of Passport issued by ICAB
  • Clearance for Inter-Country Adoption
  • Child Study Report
  • DSWD clearance

I am now looking through the information on ICAB https://www.icab.gov.ph/

My wife will also call the Philippine Consulate General to get info and we can report back our finding.

ICAB says it all ... Inter-Country Adoption Board     

 

One would have to complete the adoption process in the Philippines.

 

 

For the OP's goal of a name change, waiting for naturalization is the easiest route, especially considering they are close to 9 month from filing.

How about then getting dual citizenship for the Philippines by reapplying for passport with the name change after naturalization? Is that an issue with the Philippines?

Unless the name change took place IN the Philippines they boys name is his original name.   Dual citizenship would require he use his name of record in the Philippines.

I looked into this ICAB and it seems that it is only for children in the custody of the Philippine government for overseas adoptions. Therefore, going back to my original thinking of contacting the Philippine embassy and getting the scoop directly from them.

My wife called the Philippine embassy in NYC today to clarify. The embassy officer told her that the adoption can occur in the US in US court. Then, we need to bring the adoption certificate to PSA in the Philippines and present that to them and request a new birth certificate issued in new name based on adoption in USA. After the new birth certificate is issued, our son can get his Filipino passport changed to the new name based on new birth certificate. We want to do this as we want him to have dual citizenship.
