Confusion at NVC CEAC website

HI all, just looking for quick clarification on 3 points! NVC says they are too busy with calls now, but I want to submit ASAP. We are at the NVC stage for an CR1 Visa and just have to upload and submit documents.

 

From reading a lot of the web, the IV application is all about the beneficiary and submitting documents pertaining to them. Our case is being handled electronically, and it clearly states this:

 

"Required documents for *beneficiary*:

- Passport Biographic page

- Photographs

- Birth Certificate

- Marriage Certificate

- Marriage Termination Documentation (1st marriage)

 

"Optional Documents for *beneficiary*  Your country of origin/Consulate you are visiting may require additional doscuments for review, blah blah blah

- Add a document

 

Question 1 - Photographs are the passport photos, correct? I believe so but I was surprised they were asked for here.

 

Question 2 - On the "STEP 5 - COLLECT SUPPORTING DOCUMENTS" page for the visa process, it ALSO clearly states THIS:

If you are applying for an IR1, CR1, or F2A visa as the spouse of a U.S. citizen or Lawful Permanent Resident and your petitioning spouse was previously married:  You must obtain evidence of the termination of EVERY prior marriage your petitioning spouse has had. This evidence must be an original or certified copy of one of the following documents:  FINAL legal divorce decree, death certificate, or annulment papers.

  • Send a photocopy of the petitioner’s marriage termination document(s) to NVC.
  • Bring the original petitioner’s termination document(s) plus a photocopy to your visa interview at the U.S. Embassy or Consulate.

 

So... since both myself and my wife have been married before, it seems we both need to submit the "marriage termination" documents. However it does not specifically give me a place, as petitioner, to attach it. The only links available are for the beneficiary and the "additional documents" tab I think I need to submit them so would I attach it to the "Optional Documents" tab? It seems strange because it's not a country/embassy of origin type of requirement, it's required for all CR1 applications.

 

Question 3 - in many of the guides it says to overload on evidence of relationship to be safe. I was planning to add recent travel evidence to the application (we try not to go more than 2 months apart, so there are a few trips to list). Would this also go in the supporting documents tab? Would it get looked at and understood or just ignored, or even worse cause a problem? It seems like with electronic submission everything is more cut and dried, which is good on one hand but a bit hard to confidently overload information ahead of time on the other hand.

Yes, they are asking for passport type photos. I believe some people attached a word doc stating "will bring photos to interview" & that worked fine.

 

As for divorce decree, I did not submit mine to NVC, I only uploaded what was listed as required (I'm the petitioner), but I gave my husband a certified copy to take to the interview. I think the instructions you're looking at haven't been updated for the new CEAC system.

 

i didn't add any proof of relationship to CEAC, but my husband brought photos & copies of our passport stamps to the interview, which they didn't even look at. But definitely good to have at the interview, I wouldn't bother uploading that.

1.  Yes

2.  I would attach marriage termination docs to "additional documents".  Also make sure the applicant has an original of all civil documents.

3.  I would load any quality evidence as you described.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You only need to provide marriage termination docs for the foreign beneficiary, not the petitioner at this stage.
