RFE answer sent on may 2018 still waiting

Hello ppl

 

I sent tru my lawyer the response to RFE on may and USCIS acknowledge its reception on May 21, 2018.  RFE consisted of a letter of intent and proof of me and my fianceé seeing each other.  As for the letter of intent, true I did not include one.  My lawyer never ask me about it since it was implied in the petition but USCIS thinks otherwise.  As for the "proof" I sent DATED pictures for each trip, a whole copy of my passport showing all entries, boarding tickets of all flights, evidence of hotels stays, phone receipts.  Nevertheless we sent them anyway including more recent trips after my request.  And yes my request was sent well after the two year requirement.  I called USCIS of they have a term for answering my RFE response and the agent told to wait 60 days. 

 

Given my bad experience with USCIS nto recognizing my previous evidence of relationship I'm afraid they are delaying answers to RFEs on purpose.  Has any September 2017 experiencing similar woes with RFEs?

Nope.....they are just dealing with a backlog of petitions and RFEs.........you should just relax and keep yourself busy during this long process.  

 

BTW, we received a "checklist" from NVC in 2017......It took 12 weeks for them to issue us a "case complete" email.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Sounds like your lawyer is giving some bad advice or doesn't really know much about the process.

 

One, photos are secondary. Important items for proof of meeting are the copies of passport pages showing entry/exit of that country. Receipts, hotel receipts, credit card statements, ect, showing you were there and all.

As for the letter of intent, yes both parties must have supplied one in the petition. You will again have to supply updated copies for the interview stage also.

 

Also don't know what you mean by the "my request was sent well after the two year requirement" because no such requirement exists. You must have met in person WITHIN the last two years. That is the only "rule". Nothing about length of relationship.

Interesting, huh?  This is not the first time I've seen this 2 year relationship "requirement".  Maybe the same attorney giving same poor information....

Seems to confusion with the wording of the statement I'm guessing. Not sure how exactly it gets confused like that; but apparently it does happen.

That's the "requirement" still stuck in my head so maybe the lawyer told me that and I misunderstood all along.   As for the letter of intent, it would pain me a lot if it's something the lawyer "forgot to got trough".

 We supplied copies of my passport (all pages with very visible entry/exit punches), hotel receipts on 2 of 5 trips to that date (not on all trips I stayed in a hotel) and copies of boarding passes. Last meeting before submission was on May 2017 and date of submission was in September 2017.

I would kick that lawyer in the ...!!! Just so you know ( and I think you know by now), lawyers can delay things even more. Sometimes they mail stuffs way later from the date you sent it to them. Second, lawyers have other clients so do not think you are his top priority.

You will be fine doing it yourself. Because nobody will put as much care and love on your own immigration process than you.

If your case is not very complicated (no red flags, big age difference, different religions, previous divorces, etc), you can do this yourself just following the guides here and with the help of the big VJ community. I did this from K1 to my recent citizenship just following the guides here.

Follow my advise, when you do enter the US with your K1 and have to start with your Adjustment of Status process. Do not use the same lawyer. Do you it yourself.

USCIS does misplace things time to time so perhaps the original RFE was they misplaced some paperwork. It happens. Or your lawyer didn't do a very good job organizing the original petition. Hard to say; but processing has slowed down the last year really so at this point since you responded to the RFE you have to wait unfortunately.

Strongly considering going to another lawyer for the Adjustment of status process.  I have been a lurker in this forum and since the dammed RFE been aware that letter of intent seems to be pretty standard.

Do the AOS process yourself. We did. No RFE's, no nothing. Went through just fine. Saved a lot of money. Took us like 2-3 days to gather all the documents and all that for it all.

On that I have to give to the lawyer,  I personally saw the assembly of the original and the RFE answer.  Still that letter of intent was a blow to me :(

 

Thank you all three for your advice and hope to advise others from the mistakes and mishaps.  Sorry If today I don't make much sense.  My English circuit is way off today :D

I got my RFE digital notification on May 14th. Received the hard copy on May 18th and it was for information I had previously provided (which they probably lost in the 6 months it sat there), mailed my response with tracking information on May 21st, it's scheduled delivery was May 24th, was delivered on May 30th, and the new website said it was received on May 31st. Since then, I've heard nothing on my case. I'm glad to see I'm not alone in these taking so long, but I've also seen people have a turn around time of just a few days.

 

I doubt anyone is ignoring our cases but it's a busy time of the year. Around the time our RFEs were mailed and received was Memorial day so there were people taking off at least part of the week. Lots of people take vacation time in June. I'm sure from mid-June through to now there are a lot of USCIS resources being pulled from their usual positions to help sort our all the drama at the US-Mexico border (it makes sense that would happen, but I could be wrong). We've now just had Independence day which is also popular for people to take off before and after. I just keep telling myself that it's sat on someones desk waiting for them to come back from vacation the next day. This does, however, get my hopes really high at the beginning of each week and they fall as the week progresses.

I got an RFE after waiting 8 months for I130 smh…. I received it june 6th for divorce papers which was sent in my I130 packet and more evidence for bona fide marriage. I sent it off on june 14 and got notice of receipt for june 18th and just waiting.. well its only been 2 weeks and im already getting impatient!!! I heard it can take up to 60 to get a response sometimes longer. :(

From what I have read waiting times is usually 2+ years.  I chose the K1 route since my fiancee can be sooner on US territory.  But I am aware that's is a long road towards permanent residency.
