I think it is how you interpret "Marriage Evidence".  Evidence of marriage is a legal marriage certificate.

You can have others translate that in English per USCIS instructions and include as one of the evidences.

Yes they would also be counted as the evidence that you two are living in a marital union outside US.

 

In the mean time, file amended tax returns for last two or three years to change from single to Married filing separately. As said by others, no need of your wife’s SSN or ITIN. By the time you come to US, IRS would already have processes your amended returns and you can include those too in i130.

 

If your lawyer isn’t willing to include such financial documents in i130 package when the i130 instruction is clearly asking for it, fire them. 

 

Including as many evidences as possible with i130 is the best idea.

Our lawyer stated the same as well. I asked them to include the photos I put together and the income tax information and they just told us its not needed for i-130, but will need it for NVC stage. I am extremely worried and stressed out about them not including these extra evidence.

 

Is the CR-1/IR-1 packet different than what's being submitted with i-130?

Honestly most of here filed without a lawyer. You've come to the right place.

 

Include your Taiwan income taxes filed, that is strong evidence. Include your pictures and joint bank accounts. do you work for an American company in Taiwan?

If you have health insurance, car insurance, life insurance, retirement plans and your wife is included in them? be sure to attached them. 

And yes pictures. 

 

My advice? Do this without the lawyer. Read the USCIS website and read through the forums here and don't be shy to ask questions :)

I did, but since my wife doesn't have SSN or ITIN, I filed as single. Not sure if I should amend now...

I do work for an american company in Taiwan and they are relocating me back to US next month.

You are married but you filed as single?  That's a problem.

If I were you I would talk to the management at my American employer.  I would think that your employer would be able to help you with this.  I'm surprised they didn't give you instruction when they first employed you being that you were working overseas.  If you were married for one day of any year you must file as Married.

I was a local hire even though I work for an American employer, therefore they didn't care about my US filing status, I don't get any W-2 or anything.

It shouldn't affect your petition, but be sure to get them amended soon..I filed single on my 2016 and 2017 taxes and it didn't affect us getting a visa..Not saying it was the right thing to do, but the tax preparer told me I couldn't add my husband since he was in another country and had no ssn which I found out it was simply not true..You can add them by filing MFS with NRA written in the social part or you could have applied for ITIN...Anyways, just get them amended when you can...

I will amend them once I move back to US since it can only be mailed in. However I want to file my wife's i-130 before I leave her in early August so it's one less thing to worry about. I will also make sure I file MFS for my 2018 tax as well. Luckily my work is giving me a CPA to help with tax for 2018 as part of the relocation package. 

 

Do you think this plan will be ok?

That's good, if you have your insurance, 401K etc through them, they should be able to provide you with all the documents you need to use as evidence of bona fide marriage
