Hello everyone,

 

It's almost the time to file the I751 for my husband. 

 

here are what i'm planning to submit as proofs

-affidavit of support by family and friends

-photos together 

-photos with family and friends.

COPIES OF:

-bank statements with our names (joint accts)

-credit card statements (joint accts)

-employment letters( we work at the same place but different departments).

-life insurance docs stating that he is my beneficiary. 

-showing the same address:

pay stubs

cellphone bills ( family plan. it's under our friends name.) 

Ss cards

drivers and id.

-tax transcripts from 2016-2017

 

 

are these enough?

we don't have a mortgage. ( can't afford a house. still living with my parents and saving ul for the future.)

No auto insurance ( i don't drive but he does).

no health insurance( we have individual. our employer didn't allow us to have joint dental and med insurance.)

 

 

what else should i add?

 

I need your advice and reccommendations.

I have a month and half to gather everything.

Timeline

Consider drafting wills, medical powers of attorney, and similar documents.  These make excellent evidence for ROC, and they're even more crucial to have in "life."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

how do we obtain those? do we need to pay. we are on a tight budget as of now 😕

Your list looks good. However, the crucial thing is that your evidences shows proof of your relationship from the time of your marriage till present. So as of your bank and/or credit card statements, they should be from date of marriage (if possible) to latest one. Make sure your evidences show a clear picture. Do not add anything that would just convolute your evidence presentation. For instance, your cell phone bill, you said that it is under your friend's name. If the bills do not show your names, do not include them. Rather, do you have any other utility bills under both your names (even if they are separate bills sent to you both separately but showing the same address of residence. For example, electricity under wife's name and water under husband's name but shows the same address)? Do you have any joint lease? 

 

This is how I would present your evidences if I were in your shoes, and that things that I would add to it:

 

 Exhibit A. Evidences of Joint Residence:

-both driver's licenses showing the same address

-joint lease (if none, sworn letter from friend or family who you live with/ owner of house); make sure this document is clear to show the time span of your residence together

- add any joint utility bills (one from each year)

-add home insurance if you are renting

-add greeting cards mail to you both as couple from friends and family

 

Exhibit B. Joint Financial Record:

-IRS tax transcripts 2016 and 2017 (joint)

-copy of joint bank cards (debit and/or credit cards)

-joint checking and/or savings (from time of of marriage to latest; quarterly or biweekly including transaction pages)

 

Exhibit C. Other evidences showing joint responsibility of liabilities

-life insurance (showing the other as beneficiary)

-you can add joint gym membership, costco, or AAA

 

Exhibit D. Other Evidences of Relationship

-sworn statements or affidavits (by at least 2 people)

-photos

-add any documents of joint travels out of town (photos, itinerary, boarding passes, hotels, car rentals, etc.)

how did u organized ur file? is it better to put it on a folder or binder? and how about the photos? did u make a photo album?

As per USCIS instructions, just do a two punch hole on each document and submit them as one using fastener. I’ve read other people using separate clear plastics for each exhibit and were approved. But to follow the instructions to the letter, just submit them as one and you can use tabs on the bottom of each section to label document or exhibit for the IO’s convenience in reviewing your documents. Hope this helps.

Hello its me again.

 

My husband's green card expires on 11/23/2018.

 

When do we apply? within 90 days? 

 

The officer at the airport when my husband arrived  wrote down on the paper that we should file on Aug 22 2018 but when I calculated the days, its 93 days apart from 11/23/2018

Don’t trust the muddy math of a CBP agent who is not even tested for math before getting hired for that job. Do your own calculation. Don’t send it prior to August 25th.

That would be the best and safest way. I’ve read posts from others who filed only a day early and their applications were rejected.

If you want to be even extra sure, you can use USCIS’s own filing calculator to check the proper window time for you to file your I-751.
