Beat me to it. No need to include assets if your income is more than sufficient.

See if you can get the letter from the bank officer without your ex-wifes name on it.  That is all that is required as supporting evidence for the I-134.   You do not need to provide actual bank statements.   If the letter only has your name on it, the Consulate Officer will not beware that it is a joint account.   But if the bank requires the name of both account holders on the letter, I think you will need to include letters from both the old and new accounts with a note of explanation.   Alone, each letter would have a red flag, the first because it is a joint account, and the second because the account is new.

The other account I have is a couple years old so it's not brand new. I will have to include a statement from them anyway. The first account is Wells Fargo and while they aren't as bad as BoA they are pretty difficult to deal with. The second account I have is Simple and they are an absolute pleasure to deal with. The only issue is that they don't have any brick and mortar branches it's all internet based. I think I might just wind up closing the WF account and using Simple until the financée arrives and we open a joint account. Thank you all for all your help. I love this community and hope to be able to add perspective to others as my journey goes along.

Someone must die!?  Oh come on now.  You are talking to the wrong person at the bank.  You say you have a good relationship with your ex.  I am 100% positive that the bank can remove your ex from the account with her authorization.  Talk to a supervisor at your bank.

I take a look at your timeline, and seems you still just filed the i-129 a month ago. Bank account with ex-wife is simple. Right now, you can get a few more trip to Vietnam to visit your fiance. When the interview for your fiance is set, go and attend the interview with your fiance.

I don't know but that still seems very odd.

I previously worked in credit card customer service and that's how it was. Unless a person was deceased they were not able to be removed from a joint account. The point is I don't want the account I just wanted to know if it would send red flags closing it 6 months before the interview.

Can someone correct me if I'm wrong? If we meet the poverty guidelines sufficiently, we are not required to prove bank/real estate assets? I wasn't planning on sending these over there for the interview if we aren't required, thanks in advance.

The instructions from the i-134 ask for a letter from your financial institution. If you can't obtain that you will have to send bank statements.

Oh Ok good to know,  so the answer to this question on the VN embassy website is outdated?

 

"No.  The 125 percent minimum income requirement, the most recent year’s tax return and other requirements only apply when a Form I-864 is needed. Applicants using Form I-134 will need to show that their sponsor’s income is 100 percent of Federal Poverty Guidelines (PDF 238KB) as required under Section 212(a)(4) of the INA"

I will defer to others as far as if it needs to be 125% or 100%. I thought it needed to be 125% for a k1 because you will be filling out a i-864 for AOS which needs to be 125%

The minimum requirement is 100%, but COs from certain countries tend to go by the I-864 requirements (125%) as a minimum.

I'm unsure what Vietnam COs typically do here. But since the CO makes the decision based on the totality of the evidence, and one will be filing for AOS soon, I usually suggest ensuring you meet at least the 125% level.
