i have always wondered how many divorces is too many for immigration ?

i see many posts about divorce and appications but are there any rules to the amount otimes a person  can be divorced and still get a visa?

thank God not my problem and i am just curious

More so on how many times the petitioner has been divorced?

Or how many times the beneficiary has been divorced? Or possibly how many times beneficiary was married to say a USC previously and tried to get a visa but also denied several times?

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

No, there isn't a rule but if you petition multiple people for a K-1 visa, CR-1, then you have to apply for a waiver if you're within a certain time. They want to make sure that you aren't just marrying and divorcing people so they can immigrate. Other than that, there's no issue with previous marriages/divorces, as long as they're legally terminated. I know certain countries make divorce difficult so there's discussions on how to get divorced in say, the Philippines, on here.

No rule, there was that lady with 5 I think with a petition from Afghanistan who was having issues.

 

Most going through PI seem to have a few on the books.

Good question. I have no idea but I think it all comes down to where the beneficiary is from. 5 divorces may not seem like a lot for a CO in England but can seem extreme in some other countries.

 

I would think that having short marriages or a short time between marriages would seem like more of a problem than having too many divorces?

 

I'd like to hear what others think. Or if it was ever an issue during the petition or interview for some.

Probably does not help, especially of many have immigrated this way and there is a pattern.

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

I remember similar thread from some time ago.

 

Someone said there is no statistics for K1/CR1 divorces but this can be somewhat checked by seeing who is filling ROC jointly and how many people file with divorce waiver.

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.

24.07.2017 - NoA1.

I would think it would definitely be considered as a deciding factor, but not independently a deal breaker. For instance; if multiple divorces exist in a case, along with some other suspicious or negative factors, then that could pose a problem. But multiple divorces, standing alone as a "factor", with no other red flags may not necessarily lead to an issue.

I have been divorced 3 times.  2 of my marriages were to undocumented immigrants living in the US. and one was a US citizen.  I filed I-130 for the 2 immigrants.  Neither received greencards due to our divorcing and abandoning the petitions.  My K1 petition for my current fiance was approved with no issues/RFE.  My beneficiary has never been married.  I am 16 years older than him.  Hopefully I will have great news that his visa was approved in about 1 months time.  We are currently waiting for NVC to receive our paperwork.  I don't expect my divorces to be a problem.  My last divorce was finalized in June of 2017 (to the USC) and I filed my K1 Dec. 2017 Hope that's helpful.
