Hello,

My wife's 2 year starter green card is expiring in october, so i imagine it will be time to send in the application soon.  is this something that USCIS will notify us of?  will they send an application, or instructions?  we also moved during her 1st 2 years, so I was nervous that we may not receive the application/notice, although I did go on the website a while back and put in our new address.  how early can we send in the application?  I am sure i can get the form online, which form do I need?

 

Also, we changed her last name during these 2 years as well.  I have been very careful this whole process to do things properly and carefully, and i dont want to stop now.  So i want to make sure that i fill out the form right.  is there a place on the form to indicate change of name?  does anybody know what proof of name change I will need to provide?  I only have her SS card and receipt as of now, plus maybe a few things in the mail or bank statement (she does not drive, and we have not changed her name on her international passport yet)

Don't count on USCIS notifying you. The filing window opens 90 days (NOT 3 months) before the GC expires and you can file any time until it expires (you can file late, but obviously don't do that, it's up to USCIS' discretion if they accept a late filing and you have to give an explanation).

Did you file I-865 for YOUR (petitioner/sponsor) address change? This can only be filed by mail and is often overlooked. Do it now if you haven't yet.

If she just changed her last name to yours due to marriage then no specific proof is required. List her married name and also list her maiden name where it asks for "other names used".

I also just want to clarify, My wife came in on a K-1 Visa, then we got married, then she got her conditional 2yr green card.  now she is applying for her unconditional green card.  I see that I-751 is used for removing the conditions 'through' marriage, but it is not 'because' of marriage that we are applying, we are applying simply because her 2 years expire and she is eligible.  is this still the same form that I want to use?

Yes. Just follow the i751 guide.

I looked online, and i do not see that form as one of the available ones to file online.   unless im wrong, can someone send a link to it?  i only see Form I-90, Form N-400, Form N-336, or N-565, or pay the USCIS Immigrant Fee or Form I-131A application fee as the possible choices for online services on USCIS.gov

Wow, I never did this, just did the online change for my wife. We filed for her removal of conditions in June. Hope it hasn't caused anything to be returned. :(

I am looking through the I-751 instructions, and i didnt see it stated clearly anywhere....does the fee for the petition and the biometrics have to be separate checks?  both made out to Department of Homeland Security?  or should/could they be added together on the same check?

How to Write Your Check

Personal checks must be pre-printed with the name of the bank and the account holder. Also, the account holder’s address and phone number must be pre-printed, typed or written in ink on the check. All checks must be typed or written in ink.

  1. Write the date you are filling out the check including:  month, day and year.  Important note: Write the date of the check in the U.S. style of month/day/year. (Example: January 4, 2017 or 1/4/17, but not 4/1/17.)
  2. On the "Pay to the Order of" line write:  "U.S. Department of Homeland Security." (not “USDHS” or “DHS”). 
  3. Write in numbers the exact dollar amount of the fee for the service you are requesting. In the example, the amount is "$725.00."
  4. Spell out the exact dollar amount of the fee for the service you are requesting.  The "cents" portion of the amount should be written as a fraction over 100.  In this example, the amount is "Seven hundred twenty-five and 00/100."
  5. Write a brief description of the purpose of your payment and include the applicant’s name in the memo line.  In this example, it is "N-400 application and biometric services fee."
  6. Sign the check using your legal name.
