We're just trying to figure out the best plan of action that's not going to mess up our process but also give him as much time with his mother as possible...

 

He doesn't want to come over here and have to fly right back home as that's going to take a lot of money.

Hi.  I could be wrong, but I think the 90 days only starts once your fiancé lands.

Question for those who have already entered the US....it's about that mysterious sealed envelope. does anyone know what it contains?  I believe the embassy took my fiance's original Birth certificate and it's unclear if it's in that envelope. I'm going to assume all the immigration documents that was take from my fiance or given to them are going to be in that envelope.  I just want to confirm that before I send my fiance back to get another copy and have it translated all over again. thank you!!

Thanks for the advice. I actually ended up getting her a direct flight with my chase credit card points. 20,000 points + $150 compared to the cost of $750 with united frequent flyer program thingy.

I am sure this is a very difficult time for your Fiancé and unfortunate timing.  😞 

 

The K1 Visa is a single entry visa and has an Expiration Date printed on it.   In order for the Visa to be valid for entry in the US, he needs to pass thru POE (Point of Entry) into the US before the expiration date printed on the Visa.  

 

After entry, he then has 90 days to marry you within the US.  After marriage, he is eligible to file for AOS (I-485) and Advance Parole (I-131).   But, if he were to leave the US prior to receiving either Advance Parole or his greencard, he would not be allowed back into the US without reapplying for a new Visa.

 

There is nothing that states that it is required to file AOS within the first 90 days of entry, although it is generally a good idea to do so, as it is considered a "gray" area as to the legal status of entry if AOS is not filed yet.

 

Adding to your difficulty is that currently it takes 12 - 18 months to receive a green card and even Advanced Parole is also taking several months to obtain.

There is so much going on your lives but I want to give you some options but the first one you are beyond being able to use but there are others that may come across your post and would like to know what all the options are so forgive me for posting something you didn't know existed and quite possibly something you may have considered.

 

There are three options.

 

1. The NOA2 is valid for one year. Meaning that you would get the initial 4 months but when you are near it's expiration you could extend it out another 4 months and another 4 until you reached 1 year. The catch is you have to have the Embassy approve the extension. At one year if you had not interviewed your visa application would be "dead" and you would have to start the process all over again.

 

2. He can stay up to the day before expiration of the visa. He MUST be on US Soil BEFORE the visa expires or he will be returning back home with a denied entry. So leave with plenty of time and watch for weather delays if you are going to cut it close.

 

3. Get him to the US as fast as you can after approval, get the marriage completed and then get your AOS package off which will include the I-131 TD (Travel Document). The TD is approved in about 3-4 months after submittal. Once he receives the TD card he can return back home but not for a long extended stay maybe 90 days. Anything more than that he may be deem abandoning the AOS and they will deny the AOS. The rest of the AOS package will take upwards of a year to year and a half.

 

I'm sorry to hear of his mother's illness. My family (brother and sisters) are dealing with it now and I have beat three times.

 The embassy took my original birth certificate as well but it was given back to me in the envelope along with a sealed package and a few other papers explaining what to do next :)

As long as everything goes smoothly today, I get to see my Matt tonight! I'm so excited, but trying to stay focused on other things (like my actual job) since there isn't anything I can do except wait until 11pm!

 

His flight path is MAN > KEF > PHL > MCI

Don't know about that. I haven't been through very much yet after entering. If you just meant POE at the first American airport then you just need to bring the sealed package and your x rays in your carry on :)

Hello everyone im happy to see all those approvals.

We got approved at albanian consolate on sept 27

my fiancee was told you deserve it and congrats they took her passport and told her in a about 2 to 3 days you should have your visa it is now oct  3 and still it says application received and we have not heard anything 

i know it hasnt been a week but am still kind of worried how long did it take everyone else to get there visa on hand after there approval ?

Every Embassy is different. No two processes are the same. No one can tell you with any certainty when you will receive your visa. It's just a matter of waiting. Did they give you a piece of paper at the end of the interview as to what you need to do next?

that was her interview date and it shows non imagrant visa statues as application received 

 

That is super normal, you will see application received, then it will say Administrative processing, then you will see issued(5 days). mine took 7 days total from  interview to get Visa.  it was saying Issued for 2 days before they contacted him to pick up.

i was wondering if there is some papers that i (beneficiary) should bring with me so i can use it later in USA.

@Greenbaum or any other long time living in the USA member, according to your experience, what papers from your home country did you use when applying to any kind of filing (AOS, driver's license, job...).

of course other than Birth Certificate.
