Hi everyone, I came to USA with J1 Visa (student exchange) for 1 year. After that I changed to B2 for the first 6 months and extended 6 more months.

While I'm joining a singing competition,I passed and I will go to the second round and this competition will last until the end of this October. However my B2 will expire this August 15th (1 year).

I think about if I could change B2 to B1 to have more time or anyone know the way that I can have more time to complete my competition?

Unfortunately, that is not how it works. The maximum time allotted on a B visa is 6 months. You were fortunate to get the extension, but now you will have spent a year in the US. 

 

You can certainly apply for a B2 visa but you will almost certainly have to leave and apply from your home country.

 

Given the amount of time you have already spent in the US, it will be next to impossible for you to stay longer on a nonimmigrant status.

Unlikely you'll have success converting b2 to b1 having spent a year on a B2. 

 

As noted above, consider exiting the US and applying from your home country.

Usually visa's are issued as a combined B1/B2, no idea about status.

 

No idea how a B1 is connected to the singing competition but maybe time to think about going home?

Oh, wow.

It's time to GO HOME.  If you want B1 visa you will need to apply in the embassy.

 

But I'm going to call it now - Your chances to getting another non-immigrant visa (or even being admitted again on your current b2 visa) will be TINY. I don't think anyone will believe you were a  TOURIST for a whole YEAR. Did you win a lottery? I mean, you weren't working for that whole year.. ? My bet is both embassy/POE will not believe that you didn't work.

Time to go home and spend time there...your chances of doing COS to B-1 or getting a new B-1 or B-2 (or combination B-1/B-2) is very slim after such an extended stay.

As implied above, a singing competition is not an authorized purpose of B-1 status.

Possibly, too little information to be certain, best to speak with your Agent/Lawyer.

If you are still in status when the I-129 from your petitioner is approved, I can't see any reason why you cannot apply, assuming you meet all the criteria.

Actually getting approved is another issue...214b (immigrant intent) is likely to pop up as an issue with such a long stay in the US.

 

I'm not sure if concurrent filing or premium processing is available for P-3. As noted above, this process is due for a discussion with the petitioner's lawyer. They would kick off the process...until they do so, there's nothing actionable you can do.

Who is going to file the P3 petition for you?  And what culturally unique (from your culture) are you participating in?  Doesn't sound like a P3 to me, based on what you've said.

 

Best bet is to go home and sort it out and not take a chance on overstaying and/or violating your current status.

Don't know about this particular case, but Vietnamese nail salons are full of unlicensed VN students, overstays, etc. Through my wife and a former girlfriend, I can attest that this occurs very frequently. Local VN nail salon owners have told me how they fake certifications and hide illegal workers. They're not concerned with getting caught because "the state inspectors don't know the difference between our names and photos on the licenses and we don't speak English to them."
