I made a big mistake. I will probably enter the US on a K1 visa mid August. We wanted to do a sort of honeymoon / beach wedding ceremony and booked a vacation to the Bahama's in November. This morning I found out / realized that I can't travel out of the US until I have my greencard.

 

The only option I have is apply for the AOS A.S.A.P. and request for a advance parol, but apparently that takes 3 months.

 

Does anybody have any tips for me, or sees opportunity's I don't see? An expedited request for advance parol will not be granted I'm afraid.

AP if you are lucky will take that long. It's looking more like 5-7 month after filing for it

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

Another option is to apply for AP, do a court ceremony for the legal marriage...and do the destination ceremony as planned as a "second wedding".

 

That's provided your AP is processed and approved and in your hands physically by November.  Chances are it will not be, though.  Perhaps tickets can be changed for a later date?

That is the plan, as soon as we can we want to have a courthouse wedding. But still, we have maybe 3 months max between the courthouse wedding and the departure to the Bahamas. This whole process has been so frustrating already, and now this :X

Sometimes you just need to cut your losses.  Perhaps you can change dates or hopefully get some of your money back.

Sometimes plans just don't go as we hoped they would.

We have a no refund policy. I have to hope for a AP or just let my fiance and the kids go without me.

Good luck, but your choices are very limited.  On average, as reported by other VJ members, Advance Parole is currently taking about 118 from NOA to approval.  I have seen other recent posters who have been waiting for 160 days.  Unfortunately, this is one of the downsides of a K-1.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Look with your credit cards, many offer some protection.

 

Also, ask to reschedule your trip in the future, not a refund - that's way easier to get (since they're keeping your money).

Last year we applied for AOS AP/EAD in early July 2017 and AP/EAD wasn't approved until late October/Early November 2017. 

 

I would look into seeing if you could reschedule to be safe. We had to delay our honeymoon until his AP/EAD --> then again because he got a job and had to wait for his vacation time to kick in and some training for a new position/promotion. We are going to the Bahamas this September (finally) for our delayed honeymoon. 

 

It is no fun waiting but you would be calling it pretty close in November with an August immigration on K1. Even if you get married immediately you have to wait for your marriage license to submit your AOS (which can take days or weeks depending). 

 

Good Luck. I would look into more of the resources on this forum to learn more about the immigration processing times and transition details with AOS

10/23/17.... EAD/AP card delivered to house YAY!

K-1 comes with many disadvantages like not being able to re-enter the US without a valid parole document or green card when you leave before parole or adjustment is approved. I suggest you cancel that trip because current timelines are at least a waiting period of 3,5 months, more and so likely 5 months or more.

Granted, if you had read into the process of AOS, then you should have known you cannot re-enter the US without valid documentation and that the process has severely slowed down. This is more at your fault than a problem USCIS should care about.
