Hi Everyone,

 

Quick question. My mother was diagnosed with breast cancer in the Philippines. She refused to get treatment in the Philippines and she rather come here in the U.S to do it. 5 of my siblings resided here and we will do anything to get her treated ASAP. I'm US citizen and I submitted her I-130 today. I wonder if it's possible to expedite her case as her condition is chronic and need treatment right away. How long do you think it will take?

Hope your mom gets the help she needs.

 

Here is the criteria for a visitor visa for medical treatment; http://www.ustraveldocs.com/eg/eg-niv-typeb1b2.asp The criteria to expedite an immigration case may be similar.  The big hurdle for the visitor visa for medical treatment is showing treatment is not available in the PI and treatment in the US is necessary.  Refusing treatment in the PI and preferring treatment in the US would not satisfy the requirements for a visitor visa for medical treatment.

 

The problem is that you and your siblings must be able to pay for mom's treatment in order for her to qualify for an immigration visa.  With her cancer, she is a likely public charge.  You will need to show that she has the insurance or money to pay for her treatment.  This will be your biggest obstacle to getting her an immigration visa.  She will not be getting an immigration visa to come to the US to get free treatment.

There is probably more variability regarding treatment not available elsewhere, for examply a specialist in the particular type of treatment available.

 

Have you looked into treatment in the US, how much it will cost etc.

Even with an approved expedite (if she qualifies), she wont get to the US "right away" on an immigrant visa. Not wanting an available treatment is unlikely to meet the expedite criteria. Have you looked at the cost of US medical treatment? 

 

And her chances for a B-visa got a bit more slim with the i-130 submission.

I'm truly very sorry about your mothers diagnosis with breast cancer. However there really isn't anyway to expedite the I-130.

But what you could do is setup an appointment with such a treatment center or doctor and present those papers to the Embassy in the Philippines and hope they'll use discretion to allow her to come to the US in medically related fashion.

In the US she could well be treated by a Phillipino Nurse and an Indian Doctor.

 

At 10 times the cost. Well maybe more.

Thanks for your informative replies, everyone! Knowing that it is most likely impossible to expedite my mother's case, she finally agreed to get treated in the Philippines. ^_^ Hopefully her case moves fast so that all of us can take care of her here soon. One of my siblings will be going home to assist her with Dr. appointments and what not.

 

I am confident that she'll get better soon so I'm not worried. Thanks again, everyone!
