Hey guys, so my American husband has a DUI from 2011. He completed his AA meetings around then. He finished his community service hours in 2016.

 

We know he can't drive across the border. But we're wondering what we need to do for him to fly. I was reading about the Temporary Resident Permit and Criminal Rehabilitation. But I'm wondering if someone with more experience can point us to the right option. Thanks!!

He would have to get a waiver of some kind. Whether a TRP or something else. Flying vs driving makes no difference.

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

From what I remember, a dui/dwi is a bar to enter canada, it does not matter if he drives or flies, he will be turned around.

 

you’re best bet would be to call Canada’s border patrol and ask them what is required for him to visit.

So is TRP the one we need to get?? I'll have to talk with him and perhaps call a lawyer because Criminal Rehabilitation can only be applied for if it's been more than five years after the end of the sentence. My husband served no jail time for his DUI, so I'm not sure where we would start counting the "five years" from.

i would think the TRP would be it, but im not positive.  a consultation with an attorney would probably be the best, and the surest way, to find out positively.

Ok will do. I'll also call CBP this week to ask them what their requirements are. Thanks!!
