Has anyone had to get Representatives involved?

Hi everyone,

I've been on here a few times regarding my husband and his kids getting an Expedited or Emergency Advance Parole. He has a court order requiring him to bring the kids to Canada once a month to visit their mother.

Well, to make a long story longer, he has been to the local Milwaukee office twice regarding this. First time was the day he received his NOA and they said the case was too new. Second time was on the day of their Biometrics appointment. This time they said no unless someone is "dead or dying". He then opened an SRMT (dont know what it means). This was done through the toll free number after being transfered up one level to an officer. He then was told by another officer on the toll free line to resend everything to the NBC and request expedited service. "Send new photos and highlite the parts of the court order you want them to see". He did. He then sent it overnite courier. That was on May 2nd. IT CAME BACK YESTERDAY! It had a leeter that thanked him for the expedited request but this must be done through the LOCAL OFFICE!!!!!!

Now he has received threatening letters (contempt of court, change in custody, etc.) from his ex's lawyer insisting that the kids fly up for their visitation this Friday! They cant fly because their passports havent arrived and they dont have APs! She had no problem with the 60-90 day wait when this all started!

Anyway, I want to get my Congressman involved and would like to know the best way to go about it.

04/17/07, 04/18/07, 04/19/07- Touches on Husbands I-130, AP & EAD and both stepsons I-130s & APs!

04/23/07- Biometrics Completed(Day 21)

04/24/07- Touches on all AOS and husbands EAD

04/27/07- Interview notice received! (Day 25) (06/27/07 @ 10:00am!) Note: Notice Dated 04/23/07

05/19/07- HAPPY 1st ANNIVERSARY!!! Interview cancellation notices arrive... happy anniversary indeed....

05/21/07- AP Approval emails received for the kids! Now waiting for husbands AP approval?!?!?

05/21,22,23,24/07- Touches and stepsons and husbands APs

05/26/07- Husband and stepsons APs ARRIVE!!! (day 54)

06/11/07- EAD- "Card Production Ordered"!!! (day 70)

06/18/07- EAD- "Approval Notice Sent"!!! (Day 77)

06/20/07- EAD- Card arrives in mail!!! (Day 79)

06/27/07- Interview date (Interview WAS cancelled!) (Day 86)

07/12/07- New interview letters received for 08/09/2007 (kids wont be home until 08/17/07!!!)

09/10/07- Interview!!!! Approved!!!! See you guys in 21 months!!!

Timeline

Go to your senator's website, download the privacy form, fax it to their office with a brief letter explaining the situation and what assistance you require. Call to follow up and make sure it was received. Ask for the name, direct phone number and email address of the person assigned to your case. If they are not helpful or not interested, call another senator or congressman (in my experience, senator's offices are more helpful but certainly some people find the opposite to be true).

Has he hired his own lawyer to represent him in this visitation matter in Canada? The ex-spouse's lawyer is going to make noise that represents the wishes and best interests of the ex-spouse - that's what they're being paid to do. Doesn't mean that what the lawyer says is what's going to happen, but it very well may become what happens if your husband does not respond and respond in an appropriate manner.

Trying to push a US government agency to change its' interpretation of US law to satisfy the demands of a foreign ex-spouse is far less likely to be successful than direct negotiation of the issue with the ex-spouse. And since the ex-spouse has obtained a professional to champion her point of view your husband should do the same if he expects it to be a fair fight.
