Am I allowed to take written driver's test in Ca with expired I-94?

When I went to the DMV (I had AOS from F1 to H1B) they had to check my status with UCSIS. They have a website and you can also check your own status here:

https://www.uscis.gov/save/casecheck

My status had not been updated so I had to wait a couple of weeks, because the DMV requested the update. I also requested it on my own. I checked often until I got the green light and went back to the DMV.

The update seems to be done by hand and UCSIS pays a third party to do it, so they are slow.

Yes! Although they told us no at first (his expired within 30 days) I did a quick google search and got a supervisor involved and they allowed him to.

  • 2 weeks later...

I got a notification that my EAD has been sent to my address today (fingers crossed!).

I made another appointment at DMV at the end of August. Now I have two more questions:

1)can I apply for Real DL or need to apply for a regular one?

2) Can I also apply for California State ID if I show EAD, SSN, insurance bills and proof of residence in Ca? Or is it possible only with Green Card?

Hey if you have ead and ssn. You can apply for all that. The ID you get will be for both California state and federal. So you can basically use it for everything till the green card. You cant apply for both real ID and DL at once or hold both.

This process...if you havent read already. https://www.dmv.ca.gov/portal/dmv/detail/realid

I have to goto the dmv myslef soon here, but I am thinking the lineups without appointments is probably worse in the heat wave.

It's very probable that the DMV will issue your Real ID as "Limited-Term" and match the license expiration date to your AOS EAD expiration date.

You can but most likely it will be labeled "Limited-Term"; see my quoted post above and https://www.dmv.ca.gov/portal/dmv/detail/pubs/brochures/fast_facts/ffdl32/.

  • The expiration date will match the EAD expiration date.
  • It will say "LIMITED-TERM" in between CLASS and END (Endorsements).
  • The last 2 digits of the DD (Document Discriminator) code will be "23", as in the year 2023. Since you will pay the license fee at the end of August 2018, the fee will be valid until your birthday in the year 2023. So no need to pay any fees when you renew the limited-term license.

You can but you can only have 1 Real ID issued by the DMV, so you will have to choose. The ID will also be limited-term. The last 2 digits of the DD code will be "24" as in the year 2024 (the full term of an ID is 6 years compared to the full term of 5 years for a DL). The fee will be valid until your birthday in the year 2024. Again, no need to pay any fees when you renew the limited-term ID.
