Sigh. There is no form number written in the CASE TYPE entry field?? Example, I130 Petition for Alien relative. What is the form number given in that NOA to reference WHAT is being approved? It must have a form number for the case type it is about.

This means they will let you know about the time and date of your interview. This does not mean she is approved for green card.

 The answer would be the same if you were a same-sex couple or your genders were reversed and you were the wife whose husband were having an affair. One cannot stop their spouse's immigration process, even after a divorce.

Pull your Affidavit of Support, she will then be unable to adjust.

divorce and move on. with or without you, shell get that green card now. unless threes some sort of CONCRETE (and an affair in and of itself will not prove that) evidence that she married ONLY to come to the US or otherwise did not enter into the marriage in good faith.... well.... you got nothing.

 

hire a divorce lawyer and .... move on.

The USCIS policy manual was updated just less than 2 months ago removing the ability for an interview waiver for AOS from K-1 status. I quick check of VJ timelines shows that nearly every case is being interviewed, but not quite all yet. I guess it takes time for everything to circulate? Or maybe they are only applying the rule based on people who filed after the change?

AOS can still have the interview waived in some circumstances, just not as a spouse of the petitioner.

So, if you’ve received a notice that your case is ready to be scheduled for an interview, then an interview is definitely forthcoming?

What country is the beneficiary from? She might be from a high fraud country where a lot of folks are only marrying for the benefits. Where there signs that this might happen?

 

If the marriage was in good faith I'm not sure you have many options, outside of the ones already mentioned.
