I-130 Physical Address while tourist abroad

Hi,

I am a US citizen and want to sponsor my wife who is an Indian citizen. I live in the US however I am living in India on a tourist visa since January 2018. Do I need to put my India address where I am currently visiting and living as my current physical address, or is my US address where I reside still my current physical address as per the I-130 requirements?

Step 1 After USCIS NOA2 Gather all AOS / IV Package Documents In 3 weeks


Between USCIS Approving and NVC Case Number you have 2 to 3 weeks gather all AOS and IV Documents Get package ready.


Step 2 Obtain NVC Invoice and Case number.


​After 2 weeks of NOA2 Keep on Calling NVC every day to get case number And Invoice number


Step 3 Pay First Fee and DS261


After getting NVC Case Number and Invoice Number Log in to webpage Pay First Fee and Fill out DS261 Takes 24 to 38 Hr to get fee status paid.


Step 4 Conform Agent / Ds261 Over Phone and Sent out Documents


Once First fee turns Paid Online ( Usualy 24 to 48 hr) Call NVC And conform choice of agent over Phone If they won't keep on calling them Until someone will Or other fee won't be unlocked.Also Once you get Welcome letter on email Print out Document Checklist sheet And Sent in your documents to NVC


Step 5 Pay Other Fee and Fill out DS260 (Total time from DS 261 to here should be no longer then 15 days )


​Step 6 Conform Document delivery AT NVC And Ask them Processing Time..


Step 7 Check For CC ( Hopefully no REF )


Call them every other day 2 weeks from DS260 and Check status.. Also Check Online NVC Page If you have 3 N/A your case Complete! Congratulation you are almost done.


Step 8 48 Hr After CC Conformation Call NVC For appointment for interview


Congratulation On your NVC CC AND Good Luck with Interview

Hi there!

 

You may check this guide in filing for a spouse visa. 

  1. Payment of filing fee of $535.00 in check or money order payable to “U.S. Department of Homeland Security”   
  2. Cover letter 
  3. Form G-1145,E-Notification of Application/Petition Acceptance (this form is optional but highly recommended so petitioner will receive updates on the petition through e-mail or SMS)
  4. Duly completed and signed Form I-130, Petition for Alien Relative 
  5. Duly completed and signed Form I-130A - Supplemental Information for Spouse Beneficiary
  6. Petitioner’s proof of citizenship - any one of the following (for CR1/IR1)
    • Copy of Birth Certificate
    • Photocopy of ALL the pages of US passport
    • Photocopy of naturalization certificate
  7. Copy of Green Card - front and back (for F2A)
  8. Marriage certificate
  9. One (1) 2x2 colored photo with white background of the petitioner. Write full name in the back.
  10. One (1) 2x2 colored photo with white background of the beneficiary. Write full name in the back.
  11. If any of the parties was previously married, provide copies of all pages of divorce decree, annulment or death certificate
  12. Evidences of a bona fide marriage
    • Birth certificate(s) of children of both the petitioner and beneficiary
    • Joint ownership or lease of properties (house, car, etc.)
    • Proof of joint finances (joint bank statements, credit cards, bills)
    • Pictures together (with caption of the date, location and names of people in the picture)
    • Other evidences that show on-going marriage - chat/call/e-mail logs, money remittances, airline tickets, boarding passes on vacations taken together or visits to the Philippines

or you may call the US embassy in india where you're going to send the paperworks since you are in the country.

If qualified for Direct Consular Filing in India, it would be with the USCIS Field Office in New Delhi.  However, any visa interview would be conducted by the Consular Immigrant Visa Unit in Mumbai.

Hi since I am living with my wife while visiting India and we got married, and conceived and had a child while I was visiting on the tourist visa, would that raise any question as to how I managed to get married and have a child while my physical address was always in the US?

It's still worth checking the specific criteria with the Delhi Field Office website.  I'm on a tourist visa in the Philippines and DO qualify.  Visa requirements are sometimes flexible.  It depends on country and circumstances.

Thank you will do so! On a somewhat related question, is "Province" the same as "State" for the purposes of this form? I am asking because in India we have states and not provinces so my wife's Indian address needs to include a state name.. thanks!

September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

It depends on if the OP qualifies.  They can try certainly.  The USCIS is what makes DCF possible btw... consulates and embassies without USCIS offices don't offer DCF
