And by petitioner you mean the USC, correct? And do you all suggest I re-include the USC's birth certificate, passport bio page, etc. in addition to the documents they asked in the RFIE?

Yes petitioner (the USC). Yes we want to make sure they got all the information they need. ;)

As an employee (i.e. not self-employed), this would be how much you earn in a 12 month period. Pay stubs and an employment letter would be the best evidence of this (although tax returns as still required).

For example, if you make $1,000/paycheck and get paid every 2 weeks, that would be $1,000 * 26 (# pay periods in a year) = $26,000. This applies regardless of what you made last year on your taxes.

This assumes you don't have any income from other eligible household members (although they would follow the same rules).

My mother makes 18hr weekly pay 40000+ for the year

Assuming she is paid for all 52 weeks in a year and works 40 hours a week, that's $18/hr * 40hr/week * 52 weeks/year = $37,440/year.

If those assumptions are incorrect, then obviously the number changes.

Hey Geo thank you so much for that answer.. last week they updated my husbands case to “case is ready to be scheduled for interview” what to expect next..

Congrats. Thanks for the update.

What's next is waiting for the local USCIS field office to have an open interview slot for you. You will receive an interview notice when that occurs. Then you interview.

How long that takes various by local USCIS office. Mine personally has been in that status since November 2017. The Philadelphia office is severely backlogged.

It's possible to get an approval without an interview for K-1..although this interview waiver was recently removed from the general interview waiver criteria, so IO would proceed expecting one.

I do know they sent that letter from Missouri.. i live in NYC so it’s probably one thousand years till my interview since a lot of people files here.. did your wife get her green card tho? I thought yours was completed

Yeah, NYC is pretty backlogged too. :(

No, my wife is still waiting for an interview date. She has an EAD + AP, at least, though. So it's not optimal, but for the most part we just go on living normally while we wait out the process.

No problem! Ask away...I'll answer as I am available.

She filed in Sept. 2017 and got the EAD + AP combo card (it's just 1 card that acts as both) in early January. So it was a little over 3 months for her, but this was before the backlogs got even worse...now it's typically taking 3-6 months.

Every entry on a non-US citizen is at the discretion of CBP. But unless there is a reason to deny entry, he should be fine.

Alright....try not to go too nuts! :)
