Do you have a copy of her documents?  

 

Otherwise, Chinese citizens can travel visa free to the Northern Marianna Islands - she can meet CBP there... 

 

 

I have all documents up to 131 & ss #'s I just dont have copies of the return card. I wish she took a picture of it but didnt happen

My wife Caixia is calling it a "back card". Anyone know the real name if this card? She is still learning English so it's a little hard for her to put words together. She is doing great with the language but it's going to take more time for her. Thanks PS: It's not her or sons passport, It's not the 131 paper it is something else they must have given her at the airport.

Then I do not know what it is. I thought you guys lost the advanced parole card she got from USCIS to allow her to travel. I don't think there's anything she would have gotten at the airport that would allow her to travel back.

 

She must have an approved i-131 advanced parole card to travel back to the United States.

The only document that would allow your wife back to complete the AOS is an Advance Parole card.  If she left without it, then you have no choice but a CR-1.

You should know if she was given an EAD which also serves as advance parole or not? 

 

You say I-131 paper so if she has the paper then she can travel back.

 

If it was given to her at the airport was it a plane ticket? Is there maybe some sort of exit document she must show before traveling out of the country? Is she a Chinese citizen? Just trying to think what she could mean.

Just filing I-131 is NOT enough. Did she receive an EAD card that says on it that it serves as Advance Parole? Or a stand alone Advance Parole card? If not, the AOS is deemed abandoned and you have to file for CR-1.

It's a card. You don't get it at the airport. You get it in the mail, about 4-6 months after filing I-131.

Advance Parole is a card. If she has only gotten a paper, it would only be here Notification of action, meaning USCIS has received her application and is processing it but has not yet given her a card. If she left with only her NOA1 then she has abandoned her AOS.

 

Only time advance parole is a paper version is if she got an Emergency Advance Parole from the USCIS local office though it doesn't sound like that's the case here. 

 

It would not have been given to her at the airport, she would have gotten it from USCIS in the mail. 

You really need to figure out if she has permission to travel back into the US aka Advanced Parole card and what this "back card" she is talking about is.

The guide I linked to earlier has pictures of all the different documents, which one was it?

When she and son left because her mom needed operation from JFK it was the 131 paperwork. But she is telling me about back card which i don't understand

That doesn't make sense.  

 

There is NO WAY to get AP at the airport.

 

Did your wife receive a card in the mail?  Yes or no.  This is the only question that matters.  Without knowing the answer to this question, giving you advice would be just random guesses.

So she got an Emergency Advance Parole? Look sort of like this or similar? From USCIS local office or in the mail? Advanced-Parole-approved.jpg
