Hi,

My wife's mother got sick in China and she went back there on K1 visa with I-131, Application for Travel Document, well she lost it. what would we have to do so she can travel back here to the USA? I dont want to start a CR 1 which would take to long. Must be an easier way to get her and son back here.

The woman she talks to on chat say she must do the CR 1. There has to be an easier way when loosing her back card. DHS must have a record of this return paperwork. :(

I just dont have the money to go through a cr 1. Please help me. Thanks in advance

No she hasn't Unidentified, wouldent it be a customs thing through airport where DHS gave her a return card to get back here which she lost?

The big issue is that she would probably be fine if she managed to get to the US, CBP could look up her info by her alien number, case number etc. The issue is that no airline is going to go through the risk of putting someone on a plane that can't prove they belong in the US and risk having to pay for their return trip. 

 

China does not have US pre-clearance so, as far as I know, her only option is to contact the US embassy and hope that they can help her out.

Agreed. If she can get to somebody in CBP, she should be admitted paroled. The issue is getting to CBP...airlines will not board a passenger without a proper travel document since they are liable for not checking their documentation, return travel costs if denied entry, etc.

 

Unfortunately, there's probably not anything the embassy can do...there's no travel document to substitute for AP. Had she been an LPR or something, a boarding foil would be possible this way, but there's nothing I'm aware of for her circumstances. But still check with them to confirm.

 

I would suggest reaching out to the airline and seeing if they can coordinate with the internal CBP team that deals with airlines (I can't recall the name) to get an approval for travel. It may take some time, but I have heard of somebody getting the airline to agree to transport a passenger after getting an OK from the CBP's office.

Thanks for that info geowrian, I will call tomorrow to see what they can or will do. Airline are always open. Any help is appreciated. We came way too far to have this happen. actually a grandchild got in luggage and papers where gone.

This couple here claim they got a boarding foil even though they were only doing AOS. Not sure how accurate it is but it's worth a try.  https://www.***removed***/forum/showthread.php/110019-Advance-parole-lost-while-overseas

 

I've also seen people convincing the airline to call the CBP hotline.

Someone from the airline has to contact the liaison for CBP.  Ask your wife to go to the airport HOURS early and print page 5 here (or full guide): https://www.cbp.gov/sites/default/files/assets/documents/2017-Nov/carrier-information-guide-english.pdf 

 

Do you have a copy of her documents?  

 

Otherwise, Chinese citizens can travel visa free to the Northern Marianna Islands - she can meet CBP there... my mistake, no CBP there so not sure it would help her.  Best to have the airline call the Liaison as described in first paragraph.

Possibly, but a boarding foil is only supposed to be issued to an LPR. If that individual obtained one and their AOS was not approved yet, it was a mistake. But a happy mistake. ;) Again, it's worth contacting the embassy to be sure anyway.

 

Same. Not an easy fight with an airline, but I have seen it work.
