Hi everyone. 

 

I have a Male friend who went here in the US for a work Visa and he has have been out of status. He have found love with a guy and they decided they want to get married. This will be a same sex marriage. 

 

Now, few questions here. 

 

He is married in the Philippines, with 3 children.

 

1. Can he marry this guy? 

 

2. Will my friend have issues when filing given the fact he is married in the Philippines?

 

3. Does he need to be annulled first with the wife in the Philippinee before he can marry here in the  US?

Forgive me if someone else stated the following, but the Filipino guy MUST have his CENOMAR (Certificate of Non Marriage) issued by the Philippine Government before he can even be considered for a visa of any kind for marriage.  USCIS will require it, no if's and's or but's..   He has to be free to marry as step one to proceed.  He will also need a police report from every where on Earth that he is lived for more than (I think) 6 months or longer, issued by that countries government.

The Filipino guy doesn't need a visa.  He's already in the US.  He doesn't need a CENOMAR because he doesn't need a visa.

 

USCIS will not require a CENOMAR.  That's not a requirement for AOS

 

He will need a police report from the PI.

I will take your word on this, i do not know however,  the small village in zamboanga del norte my wife lives in has several openly gay men some of which are the children of prominent local businessmen and there seems to be no difference in how they are treated

Can he get a CENOMAR. A Certificate of No Marriage Record (CENOMAR) is simply what its name implies. It is a certification issued by the PSA stating that a person has not contracted any marriage. Also called a certificate of No Record of Marriage or Certificate of Singleness.

So basically regardless of outcome - he’s probably not going back anyway.
