Migrants labelling themselves as asylum seekers has no legal basis.

This commitment was codified and expanded with the passing of the Refugee Act of 1980by the United States Congress. Besides reiterating the definitions of the 1951 Convention and its Protocol, the Refugee Act provided for the establishment of an Office of Refugee Resettlement (ORR) within the U.S. Department of Health and Human Services(HHS) to help refugees begin their lives in the U.S. The structure and procedures evolved and by 2004, federal handling of refugee affairs was led by the Bureau of Population, Refugees and Migration (PRM) of the U.S. Department of State, working with the ORR at HHS. Asylum claims are mainly the responsibility of the Bureau of Citizenship and Immigration Services (CIS) of the Department of Homeland Security (DHS).

That is because the ones that cross over Illegally and try to claim asylum are thus still Illegal. They are illegally here in the USA and so thus they Illegal.

Crossing the border is a misdemeanor. Is everyone who allegedly commiting a crime labeled illegals?

Yes, a Federal misdemeanor which is worse. No, just people crossing the border illegally are thus called Illegals. Pretty commonsense if you ask me.

Sounds like you are an expert on the matter?  Tell us how to tell the difference, please?  So CBP can spot them as the come across, yanno?  Would make their jobs a LOT easier if they knew too...

Alledgedly? What is allefedly about it? A clue may be a lock of passport/visa/stamp

 

Last time I looked a misdemeanour is an offence.

I am speculating this is not a legal forum and we are not lawyers. Maybe the folks were born in East LA. Maybe when you are on USA soil you are entitled to a presumption of Innocence, maybe your claim to assylum is legit. Would be good to legal advice before jumping to conclusions. 

 

At any rate "illegal immigrant" is a good spin marketing label from the Nativist elites but not a legal status.

You are quite right, this is not a legal forum, however to call the term illegal immigrant a marketing ploy is a little presumptive on your part ssince this is also not a marketing forum either. 

 

What would you call someone that has not legally applied for immigration benefits, failed to apply for asylum at a proper crossing point  or paid someone to bypass all the legal avenues for entry into this country?

Not sure to whom you are referring, either as poster or as immigrant.  But unless one applies for a visa and enters the country, or is granted asylum, they are an illegal immigrant.  As opposed to the other two, which are legal immigrants.
