Still wondering how you intend to fund the Health Care of a 78 year old.

While we are battling thru the court process to get an order released for passport office to make the correction (weird, that office even though it was their own mistake, wouldnt do without a court order, go figure! :) ), meanwhile I am thinking of contacting either the NVC and/or the embassy where the case will go for interview via their direct email (or contact through my attorney) explaining them this situation providing trail of our ordeal. What I am hoping remotely possible is they see clearly its not our fault and allow us to use the current passport that is valid and make a record of this change. I am not sure of the outcome but what I am weighing in is the idea to contact them ahead of time to see if they had a case like this and suggest us anything in the meantime. Share your thoughts on pros and cons on going with this..

You are wasting time and energy.  

 

Contacting the NVC and the US Embassy will not yield anything.  If you want your attorney to do it, he will be happy to take your money.

 

Sure, the US Embassy will be completely fine with your mother using a passport with false information.

 

There are plenty of cases of people using passports with false information.  They probably will all suggest fixing your mother's passport because using a passport with false information didn't end up to well for them.  

 

Everyone has shared their thoughts with you, and you ignore the advice.  The cons of using a passport with false information is a life time ban.  The pros of your approach to explain using a passport with false information is NONE.  

 

Get this out of your head - you are not special.  You and your mom will have to do things like every other US citizen petitioning a parent.  You can not explain away using a passport with false information.
