Hi everyone,

I am US citizen and filed I-130 in Jan 2018 for my mom. Just recently, my only other sibling alongwith his family, whom my mom lives with, got employment based US immigration so now there is noone my mom can live with back in Paskistan. I hear it will still take several more months for mom's I130 to get approved. Does anyone know how much longer? Does this constitute a request to expedite? This is becoming a serious problem which we didnt know would be such a timing issue where my brother has to join his US employer but does not want to leave his family with mom or take his rest of his family and leave mom alone. Please suggest!

I can't imagine the stated situation would meet any of the criteria above, but you're free to request one if you really want.

Expect ~12-16 months from I-130 filing to interview.

You need to wait for a visa to become available, they are limited for parents, there is no expedite

 

perhaps your mother can live with one of her siblings or other family temporarily? alternatively, your wife and your brothers wife could take turns staying with your mom until her visa is processed

I see the unlimited visas for parents that Dee elle (Thanks) mentioned, on uscis site at;

https://www.uscis.gov/greencard/visa-availability-priority-dates

 

At 78 years of age, its hard to adopt to something new when one is never used to so we are worried about causing any health issues as a result. Thats whats making it very difficult. Anyone to share on requesting expedite on similar reasons?

Your mom does not meet the criteria for an expedite.  Don't count on it.  You need to deal with the choice to leave your mother alone realistically.  Remember, you and your sibling are make the choice to leave her, so you need to be realistic in dealing with the consequences of your choices.

Hi everyone,

My mom traveled to US 12 years ago and had a green card that is now expired, i130 filed again this year and now waiting for interview. Meantime her renewed passport in Pakistan has wrong month and day printed and the passport office has long list of steps to correct it (very difficult to run around and follow!). We got copies of all previous documents and everything that she will take to consular office to try to explain should they bring it up. Anyone with thoughts on it or knows someone with similar experience? Thanks

If the passsport is wrong, they will not approve the visa until the passport is corrected no matter how many documents you take, so you'll have to follow that long list of steps to get it corrected. The visa must use the information in the passport for the bio-data (name, birthdate, etc.).  The information in the visa system is then used for producing the new green card, so it must be correct.

Jan22, If we use the same birthdate in DS160 form that is in renewed passport would work since both will be same and they can use the same on the visa and make this birthdate to go forward with?

one of the long list item is to get court letter and we have court documents for last 8 months which doesnt seem like getting to conclusion (I see in news there are lots of people with similar mistakes in ID cards and passports). so the key is US consulate would need to be convinced its not our mistake, then the rest of process can use the now-passportdate moving forward (thats the big iff).  By the way, the renewed passport has worked for dubai and turkey which was needed meantime, not yet for US so wanted to know if we can avoid trips to courts which are no fun at all :)

Providing documents with false information is a seriously stupid idea.  Once your mother is labeled a liar, she has zero chances of a visa.  It will not matter what other documents she brings and what excuse she has.  Filing immigration paperwork with information that she knows to be false will destroy her credibility for the truth and she will never be able to escape that.  Yeah, this is just plain stupid to do.

78 with health issues, have you thought this through?

As others have already said, you cannot do this. You must get the passport corrected. Your mother's information, with the correct birth date is already in the US visa/immigration system.  To present a passport with a different birth date now, you would have to prove a) it is the correct birth date, and b) why you used a different birthday when she got -- and used -- her first US visa aND green card.  You won't be able to do that.  And, again as others have stated, presenting a knowingly false document may result in your mother having a permanent ineligibility for any US visa. 

 

BTW -- the US doesn't care that Dubai and Turkey accepted the new passport. In fact, if you use that argument in support of your case during your US visa interview, it may lead the consular officer to question what other false aspects there are to your application that you're willing to take advantage of to gain an immigration benefit.  Incorrect documents are nothing to mess around with in this process. Get a new passport, whether it's a fun process to do so or not.

While we are battling thru the court process to get an order released for passport office to make the correction (weird, that office even though it was their own mistake, wouldnt do without a court order, go figure! :) ), meanwhile I am thinking of contacting either the NVC and/or the embassy where the case will go for interview via their direct email (or contact through my attorney) explaining them this situation providing trail of our ordeal. What I am hoping remotely possible is they see clearly its not our fault and allow us to use the current passport that is valid and make a record of this change. I am not sure of the outcome but what I am weighing in is the idea to contact them ahead of time to see if they had a case like this and suggest us anything in the meantime. Share your thoughts on pros and cons on going with this..
