To an official who discovers that you falsely claimed to be a US citizen, it might appear to be more about character......that's why trying to correct the claim might be important....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

the fact of the matter is that any federal paperwork that you file will be eventually scrutinized for their veracity. You might think not, but misrepresenting yourself by "mistake", still counts as misrepresentation. If they find out even years later, you will have to answer to it. I have warned my wife about this kind of mistakes, this could turn into a nightmare for not being aware of the consequences. FAFSA is a federal document as well as for the I-9

The 1996 Law has the false claim to USC. 

The I-485 does not ask such questions. N-400 does. They still have to prove it. 

 

I do know by law that employers keep I9 for 3 years and then it can no longer be valid. I am not sure if you can go back and correct it. A very experienced immigration that deals with these kind of issues would be recommended. I have never heard of traveling issues on GC with false claims unless you lie to the officer at CBP. 

 

I believe the 2013 Senate immigration bill that passed had forgiven false claim. Never got a vote in House. You can always wait till Immigration Reform passes. It can even be this year before elections and see what the law has in it. My prediction is that they will forgive such incidents. That 1996 Law was very strict especially the 3/10 bars.

 

I have read successful cases where the lawyer defended such incidents. I think it would only come up if you had other records like criminal (DUI, drugs, etc). If this is your only mistake I doubt they will pull it up but again please contact an experienced immigration attorney that deals with these issues.

If the OP lied about her citizenship status, she should not say she was mistaken, but to apologize. She doesn't want any further misrepresentation. OP may also want to record any monetary benefits (scholarships etc) she got as a result of her claim to be a citizen.

In order for you to move to the US with your Visa your mother would have had to give your father permission for you to leave your country.

I don't know how you can move to the US move in with your father and him not have custody? 

Did you actually try to get a US passport?

But she did not intentionally lie. She genuinely believed she was a USC because she arrived as a minor with her father, who is a USC. I have to say that the rules regarding citizenship for children are very complicated here. She didn’t claim to be a USC to gain something to which she was otherwise unentitled. LPRs can work and receive student loans. This is a completely different matter than someone who knows that they are not a USC but lies and says that they are purely to gain something that LPRs are not entitled to such as voting for president or certain welfare benefits.

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
