I am a LPR and I have checked us citizen on i9 and on FAFSA . I just recently realized how big of a mistake I have made and have decided to not apply for naturalization. I want to travel to my home country to visit my mother but I am worried about my school federal loan that says I'm a citizen being discovered. I have talked to 2 immigration lawyers , the first told me it would be a risk to travell abroad as we don't know what the customs officer see on their database.The second one told me not to worry so I am not sure what to do.  Has anyone been in or knows someone in a similar situation? I can't imagine never visiting home and seeing my family however I can't risk being removed, I have a usc child and if I was to be removed his father would not let him go with him or let him visit.How does uscis and border officers finds out about false claims?I appreciate your responses in advance.

One way or another this will probably come up eventually. You will have to renew your green card at some point, no?

If you ever try to naturalize, they will probably notice it. They will also ask about it on the N-400.

 

The best thing you can do, IMO, is try to fix your error by retracting the false claim to show that it was not intentional and hope for the best (assuming you make a timely retracting):

The alternative is to just not touch it and hope they never notice. Never lie about it.

I don't plan on lying as I will never apply for n400 ,I am okay with renewing my green card every 10 years but I am worried about travelling. I should have added in my post that my father is a naturalized usc and both he and I thought I automatically derive it after he brought me here but he did not have legal custody of me which is one of the requirements and so I can not apply for the n600 as I had thought o could.

When you renew your GC, you will be asked if you have made false claims. Update the paperwork you know you filed incorrectly and answer the questions honestly.

Haven't you already lied to gain benefits of a US citizen?   I agree with @geowrian.  I would try to fix this thing before it snowballs..

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That does not guarantee that it won't be found at a later time......and the result will be the same.....

How did your father bring you here if he didn't have custody? Did you move in with him when you moved to the US.

No sense on giving you a lecture, but even un-documented people who have lied on the work form to gain employment and later trying to adjust status have to disclose this. Misrepresenting yourself as a USC is a big time NO! Hope you can solve this.
