Filipino married twice in the Philippines

Hello All,

 

Our K-1 is progressing well and we are waiting for the Interview with the US Consulate.  In the meantime, a friend of my fiancee is pursuing a K-1 as well.  She intends to get a divorce in Hong Kong (as you cannot divorce in the Philippines) however, she was married twice in the Philippines.  

As far as we know, only the first marriage in the Philippines is considered to be valid.  However, will the CENOMAR reflect both marriages or, just the first one?  How will this be view by the US Consulate?  Will the Consulate require a divorce for each marriage?

 

Anyone have any experience of this nature?

So she was married twice in the Philippines, are both marriages registered with the PSA?

She committed bigamy within the Philippines? That can be a very serious offense if she returns and is caught.

 

Only the first marriage is valid under US law. She will be issued a CEMAR with all known marriages noted. This would be presented to the Manila CO (assuming she is interviewing there) along with the final divorce decree for the legal marriage. The CO won't care that the divorce is not recognize within the Philippines....but he does need the CEMAR + divorce decree for the marriage.

 

She also may want to have records of the second marriage in case they want to confirm that it is not legal. That may need to go through additional processing after the interview to verify things, so don't be surprised if the case goes to AP. I'm not saying it will...but be ready in case it does.

Request a CENOMAR from PSA  this can be done online.    This will answer your questions regarding if one or two marriages are recorded.     (hopefully only one ... two would be .. yikes)

Again, this is for a friend of my fiancee (thank God).  Her friend will be interviewing in Hong Kong.  As noted below, it appears the only true way of finding out is to place the order for the CENOMAR and see what happens....

Sorry I was just trying to reiterate that point and confirm it for myself and other people. 

 

Pull her CEMAR and see if she only has one or 2 marriages on it.

How does someone view their CENOMAR?  It is my understanding that the CENOMAR is mailed directly to the consulate's office.  Is it possible to have one mailed to a residential address?

No reason for the CENOMAR to be sent directly to the embassy unless you requested this to be done.   

 

Anyone can order a copy of their CENOMAR (CEMAR) and have it sent to their home.

You can get a CEMAR or CENOMAR directly. My now-wife still has hers. It was presented at the interview, not sent to the embassy.

Hong Kong requires that the CENOMAR is sent directly to the US Consulate's Office in Hong Kong.  They will not accept a CENOMAR that is brought in by the petitioner.  This requirement was listed in the letter sent to my fiancee in Hong Kong from the US Consulate's Office in Hong Kong.  The letter is very specific on this requirement.   

 

However, it is good to know that my fiancee's friend can order a CENOMAR and have it sent to her home address.  This will answer their original question.

Good to know.  We will advise her to order one and have it mailed to her personal address.

I understand that.

 

But you have another issue .. is there one or is there two ....   and you can order a separate CENOMAR to find out for sure is what I was saying.
