Timeline

I have been going here in the US for 3 consecutive years now. The longest is this year, and I am maximizing my allowable stay which is 6 months and I have a fiancé who wants to get married soon. However, I have a return ticket dated October 3rd. My questions are:

 

1. What is the process of changing my status from B1 visa to spouse visa (correct me if I'm wrong here, I am not really familiar with these things)

2. What forms should be filled out?

3. Can I apply immediately the next day after our wedding?

4. What is the timeline for all of this?

Are you in the US right now?

If YES, then no problem, there is a process for that.

If NO, then what you are planning on is visa fraud.

~Moved to Adjustment of Status Case Filing and Progress Reports as OP is trying to adjust from B1/B2 visa~

 

So you are currently in the US on a B1/B2 visa? You can marry and adjust status. Time line im not sure about but as soon as you marry, yes you can apply for adjustment of status once you have official marriage license or certified copy from your local county clerk.

02/03/2017 - Married

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview
