Help with I-864 (Self Employed)

I need some help on filling out the I-864 form.

The first, is on Part 2 item number 2, could I put my U.S physical address for my wife and  put her name on the “In Care of Name”

My second question is for part 6 item number 7.

I’m self employed and in my taxes I have two different income amounts. In this part should I put my income without the profit or loss from business?

Or should I put my income including the profit/loss from business on part 6 item number 20?

I also didn’t file taxes on 2016, I didn’t earn enough to report to IRS. What should I put on part item number 24.c? Will I need to provide evidence why I didn’t file taxes that year or it won’t matter?

I believe you would put your taxable income that you used on your taxes. That would (typically) be after losses or business deductions.

 

Even though you did not have to pay taxes in 2016, you still should have filed a return. If I were you I would file, get that transcript to include.

 

Im not positive but because of the discrepancies and income level being so different, so close to each other, you might want to consider getting a co sponsor to help 'even out' that issue. Some consulates care more than others, and you don't give any details as to where your spouse is.

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

Your current income and your income for the tax section of the affidavit will come from line 22 of the 1040 form.  Current income from line 22 of the 2017 return.  For 2016, if your income was below the filing threshold, simply hand write, "Income below filing threshold" in the available space.

 

Being self employed is a double edged sword.  One edge reduces your tax liability by deducting allowable business expenses and the other edge reduces the income you can use to qualify to sponsor an immigrant.

Facts are cheap...knowing how to use them is precious...

Thanks, so I shouldn’t put what’s on line 37?

I want to clear that up because I read somewhere else on this forum that I should put from whats on line 37 and on others line 22.

Yes, it sure is a double edged sword.

Yes, it sure is a double edged sword. 

Why not simply confirm by studying the actual instructions, which indicate that adjusted gross income is entered when using the 1040EZ (never used by the self employed) and otherwise enter the total income.  Total income comes from line 22.  However, on many tax returns, AGI and Total income numbers are the same.
