I am interested in withdrawing my old K-1 before I submit the CR-1.  In my research and even on the USCIS site it states that the petition can only be withdrawn prior to adjudication.  I would like to, for my own peace of mind, withdraw the K-1 so it will not have an impact on the CR-1.  

 

Information out there is squiffy at best.  It seems I send a letter to the US Embassy in the Philippines and copy USCIS on it.  There was no information on where to send the USCIS letter but I assume California since they had the petition before NVC.

 

From what I can tell is I send a letter with all pertinent identification stating that I wish to withdraw the K-1.  Some places say to include an explanation while others say do not.

 

Any thoughts?

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Yes from what I've read it's best to send a letter to both the embassy and NVC. Technically USCIS has nothing more to do with it but not a bad idea to also send one to them honestly.

 

Canceling/withdrawing officially is best route as the stories of 2-3 years later petitions still being active in the system has happened and can cause issues.

 

I would say write to all three places with the case information and request an official withdrawl of it all to make sure it gets returned/removed from the system.

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Thank you.  I will do this today.  I have the address for the Embassy but do I send the USCIS letter to CSC where they handled the petition?  I will find an address for NVC.

I can do both.  It will just be a copy of the same letter.  I am hoping to submit the CR-1 mid July after we receive the Marriage Certificate from PSA.

Huh?   There is nothing to withdraw.  USCIS completed their processing of the I-129F petition, sent it on.   The embassy DENIED the visa, returning the case file to USCIS  ... cycle complete.   It was DOA upon denial.

Ah if it was DOA then yes nothing to withdrawl technically. I need to keep up with timelines better hah.

I have read about cases where the new petition was denied because a previous petition was still "on the books".  I guess I was just looking to be thorough (this time!).

Don't mix apples and oranges.      The key factor with the other case you need to KNOW is -  were they denied at the embassy or did the petition/beneficiary just drop the process and walk away.

In your case ... it is DOA!    

 

You  are now trying to DO-DO when DO will DO.

Yes PLDT , or any of them for the matter, are a test of patience.   SMART owns PLDT (or visa versa).   

 

We currently have Sky for internet at our house in the Phils, P1800/mo for 20MB speed, unlimited data  (installation was P3,000)... so far so good.   

 

Ya, relax ... that horse has been whipped to deal and dragged to the curb  ( returned to USCIS with the big RED stamp on it.  ;)    )

 

 

As long as you answered Part 5 correctly .. all is good.

As long as you answered Part 5 correctly .. all is good.

We are paying (or were going to pay) PLDT 1899 for 20 MB unlimited.  We will give them a couple more days and if they can't get it activated we will look into Sky (if they do Pateros).  

 

I read the I-130 instructions at least twice a day...NO STUPID MISTAKES this time!
