Hello,

 

Got engaged to a Vietnamese woman over a year ago. Filed paperwork for K1 visa. It got approved stateside and made its way to the Vietnamese Consulate. I never found out if she was sent an interview request or not, but we broke up and haven't spoken since.

 

Am I required to cancel this visa? I am dating a nice woman from Philippines and while it will be at least another 6-12 months before we even think about going down this route, I want to know what I should be doing here. Has my visa application expired/canceled due to inactivity or will I need to write a letter somewhere? And if so, do I have to write directly to the Vietnamese consulate? Appreciate the help here.

Yes. As the petitioner you should write to USCIS with all case information and ask for it to be withdrawn/canceled. Do not assume it will actually expire. There have been stories of some petitions being found out to be still active 2-3 years after the fact. Ensure to have it withdrawn/canceled to avoid any issues later.

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Nov. 2016 - NOA1 

April 2017 - NOA2 (6 months!)

April 2017 - Arrived to NVC

April 2017 - Got the # from NVC

May 2017 - Case left NVC

May 2017 - Arrived to Embassy

May 2017 - Got Package 3 

May 2017- Got Package 4

May 2017 - Interview [APPROVED!]

June 2017 - Visa arrived home

June 2017 - Made it to the US. Finally with my future hubby!!

July 2017 - Married!

Thank you! Where exactly do I send it? I saw a sample letter canceling the application (which I customized heavily), and it mentions an address of filing location. Is this the address where I filed it in Texas? or is this the NVC?

That in itself is a good question, I myself have never specifically looked into actual mailing location, honestly might not hurt to mail all of them, NVC, USCIS, lockbox, ect... just to make sure someone sees it and pulls the case from the system. Let me see if can find some more specific info on here for you.

I really appreciate this. I usually do a great job of finding info online, but I get confused with the acronyms and process here and could use the help.

Went through a few older threads, one person who had their petition at the embassy level sent the withdrawl to the embassy and they had it returned to NVC then to USCIS for cancellation. I myself again may advise to send to all three departments, just change heading and such and use specific case numbers whether USCIS's or NVC's depending who you send it to. Yes, cancel it. It should expire on its own, but that can take a year form when the embassy got receives.

Send a letter to both USCIS (they ultimately are responsible for the the I-129F even if they don't have it) and the consulate.

 

Hopefully she didn't pursue and/or actually receive the visa. If so, that may look negatively upon you (i.e. concern that you are just bringing people to the US).

Exactly. Especially in cases where the US petitioner petitions someone new after having petitioned someone else not too long ago.

If you have the case number of that case, and you can check the status on ceac check visa status, and show as ready, mean it is at the consulate, if you are sure that the case is at the consulate then, send a letter to the consulate and withdraw the petition.

I had a first k1 visa petition at the consulate, and my ex sent a letter to the consulate yo cancel that petition, then i apply with a new k1 from another fiance

N-400 online April 27, 2022 base on 3 years rule, biometric reused.

January 11, 2023 oath ceremony, Indianapolis. After that done with uscis😂🤭🤫

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

They said they needed a notorized letter as well as my passport and a few other docs, but said i could scan all of those things and email it to them. That was surprising. I didn't expect you could just scan a notarized document and have that be sufficient. Hope the process is as smooth as they indicated!
