I went through the K1 visa process last year. I entered the country using the 1 time use K1 visa. I did not complete the process as the relationship did not work out and I left and went back to Canada. I am planning on travelling to the US but my Canadian passport has the K1 visa still stapled to it along with the sticker that was placed by customs. Do I need to get a new passport or contact anyone to let them know I withdrew my application for citizenship. My only intention is to visit family and not to stay. Any help or guidance would be appreciated.If you

You do not need a new passport.  Getting a new passport does not erase your K1 visa.

 

You did not withdraw your application for citizenship.  Citizenship is not in the mix for the K1 and is another process that would have been years off after the K1 and adjusting your status for a green card.

 

You were in the K1 process.  You completed that by using the K1 to enter the US.  You just didn't start the next step which was to marry and file for a green card.

 

At the border, you can tell them that the relationship is over and you have returned to Canada.  Bring proof of your residency in Canada.

You entered the USA legally and also you exited that USA legally. Boarder Patrol Agents and their system have records of you doing so and with a click of a button they will show all your information when you arrived and why you arrived until you left that USA. You followed the laws and none were violated and I see no reason for panic. If asked, you will explain to them and you are good to go.

K1 is a one-time use visa that you used. So it is somewhat irrelevant now. They will probably ask about that relationship be truthful it no longer exists. Show ties to Canada to overcome any immigrant intent. You should be fine.

That K1 visa is no longer valid for travel as a one-time use visa. As long as you exited the US within the stipulated time, you're fine to apply to reenter. 

 

Just be honest with what happened, if asked; most likely would not be an issue.

CBP: Ah I see you had a K1 visa at some point

OP: Unfortunately that relationship didn't work out.

CBP: Oh sorry to hear that what do you do now

OP: I work here

CBP: When are you returning to Canada

OP: this date

CBP: okay have a nice trip

Just to be thorough, how long was you in the U.S. on your K-1 before you decided to return to Canada?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process
