Just wondering if anybody can answer my inquiry. Here's my query, does a filipina married in the Philippines who is naturalized british citizen but divorce with her exhusband in UK can marry a filipino citizen staying in Texas, USA holding tourist visa? If yes, how and where?

She can. She should have her divorce records to prove she is no longer married. That requirement varies by state. However, she will not be able to stay after the marriage. She will have to return to where ever she's living while a CR1 is filed.

Google “marriage in Texas”. Plenty of info. Various county links eg http://www.dallascounty.org/department/countyclerk/marriage-license.php and some private website links too.

Is he also a dual/US citizen, or a green card holder? 

 

No issues marrying while visiting;  she then returns to the UK and await the visa (F2a/CR1) process there.

Nothing wrong with it (plenty of people do destinations weddings!)...but I am a bit curious on why it needs to be someplace where neither of you live.

 

The exact requirements and procedures depends on the local county, but basically you apply for a marriage license with the County Clerk. After 3 days, you can then marry in a courthouse or other officiant.

Why Texas? I mean you can marry in UK or Philippines - are you planning on staying in US? I mean just getting married in there won't give you any basics for legal stay.

Well Philippines may be out depending on who filed the divorce (used to be that it had to be the non-Filipino spouse though heard rumors of changes recently).  She would have also have had to file those divorce papers with the Philippines court to have the CENOMAR updated to reflect that.  Could be a bit of a pain seeing how she's living in the UK.

 

Also doesn't UK require a month of being in the UK before a marriage license is issued?

Wait...if one of you is Phil/UK dual citizen and the other is a phil citizen

why not gonna get married in either the uk or the Philippines?! 

The US tourist visa would not qualify either of you to reside in the us, no matter where u get married

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

how can one stay in Texas with Tourist Visa? 

why marry where none of you have residency?
