hi  please  i wonder  if  our  age difference it  ll be  a problem to get Visa  cr1  or  k1   then  i want know which one it will be more better for us !

im 23 years  then she had 36 years  she visited  me 3 time  the first trip 13days  sencond time 22 days the last one  26 day she is with me right now  we also have  pictures  together  , plane tickets  , transfert receipts money ...   

so i just want know assoon as possible  what we have to do  as long as she is with me yet   

 

age difference  23years  36years ?

which kind of visa  we have to apply for ?

Being from Morocco you still have an up hil battle for a K-1, even for a CR-1. 

 

Some will say skip the K-1, marry and do CR-1; but just marrying doesn't guarantee anything. You need to be able to show strong bonafide relationship evidence and over come the age difference and the fact you're from a 'high fraud' country.

 

The face time she has spent there seems good; but I'm sure others will say more is still needed. For me you can try either visa; it's more a personal decision on your part if you want to marry first or not.

I generally think that the cr1 is the better way to go.  The age difference can be a red flag but I can tell you from my experience that so far it hasn't been for us getting the I-130 approved.   We have a larger age difference.   We did a DCF filing since we both reside outside the US. I personally filed the I-130 and the USCIS reviewer was impressed by all of the travel and home photos we had together and didn't say anything about us only being married 3 months and just verbally  confirmed our birth dates to our birth certificates. 

 

The benefit of the CR1 is your spouse can work right away and it is cheaper.   If you file in the US is should take slightly longer.

Also - how long have you been in a relationship?

 

Look into differences between K1 and CR1 timelines. K1 is more expensive, will take shorter, but you won't be allowed to work/leave the country right away. With a CR1, you'll marry before and can work/leave the country right away but it'll take longer. It's a personal decision.

K-1 is taking about 7-9 months right now, CR-1 is about 12-13 months... So yes, basically would advise at least 1 more decent length trip during the process. If you married and did CR-1 is basically would be two trips, one for the marriage then at least one during the 12 month process.

Main issue for them is Morocco is high fraud country and the USC is the female, and older than him. That is generally why the age difference becomes a red flag. When the male is older usually doesn't matter much in a lot of countries.

Any "issue" or flag can be over come. You asked so you're getting the upfront honest information. Morocco is not an easy embassy to go through because of it's reputation for fraud. One general common thing with it is older US females and younger Moroccan males... again anything can be overcome. As to which process is best for you that is only up to you and your lady friend to decide. As some pointed out above, each one, K-1 or CR-1 has it's own pros and cons and those are things both of you have to consider before jumping into the waiting game known as immigration.

Not really. While future potential opportunities are good; if you go the K-1 route you can't work for 4-5 months after arrival into the US and receive a work permit.

 

CR-1, even upon entry you need to physically get your green card in hand.

 

Again though "future" work isn't really considered. Only work considered and all is about the petitioner and their finances and ability to support you.

your biggest hurdle is not the age difference, is going to be the bonafide relationship for K-1 or CR-1. Other VJ suggest more face time and more evidence of the ongoing relationship proof.  we did it in Ukraine and although some may say it's a high fraud country....we tried to gather the most amount possible of proof of relationship.  It was the variety of evidence that helped our case, loads of face time. The courtship was short, but by the time the interview was there, we had 4 lengthy face time periods and she saw my family and I saw hers. Concentrate on multiple types of evidence, not just pictures! We traveled quite a bit and i had Hotel bookings, airfare, luggage tags, restaurants receipts, museums, other venues, chat, video chats logs, passport stamps, meetings and pics with family.  Financially although my wife had her own bussiness, I send her snail mail, postcards and a present for x-mas and for her b-day, the occasional U$D for new passport or medical fee, and interview, so she didn't have to spend it. Everything on paper so we have it ready for the CO. All this suggestions are mainly for k-1 and the facts that i was at the interview....Bingo! Visa approved.

A lawyer won't help you get a visa approval. The only thing they can help you with is putting together the paperwork, and I'd say that VJ is a better resource, especially when it comes to a high fraud country like Morocco. The best advice has already been given (spend a lot of time together, consider marriage and a CR1 visa).

 

You could go the K1 route, but given that your age difference is greater than 10 years, I do think a CR1 visa is a safer option. K1 approvals in Casablanca are rare, and while CR1 visas are also difficult to obtain, you have at least shown some dedication in getting married. You might also have the option to reaffirm the case if you were to be denied (unlike the K1 where if you are denied, you start over from the beginning with a new visa petition).
