Hi Friends!

It's hard to believe its been nearly 12 years since my husband entered the country and we are preparing now to fill out the N-400. This site was a lifesaver for me during that nail-biting waiting period and I'm back again to my VisaJourney family to ask for advice on the N-400.

It's nice that it's available online and I skimmed through the application we're going to fill out this weekend and wanted to have everything  I needed before we started. My question is What do they mean when they are asking for evidence?

Do I have to upload documents that show we have bills in our name, our house, our car, etc? What constitutes as evidence? I couldn't see a lot online.

If he has had his GC longer than 5 years I believe he should be applying based on that and not based on marriage. So you wouldn't need evidence to prove you marriage. I'm sure someone with better knowledge than me will be along soon.

If you're filing under the 5-year residency rule then you need to upload a copy of the front and back of your current GC.  

If you have a criminal history in any country, you need to upload a copy of the court-certified statement(s)/disposition(s) for each case.

No proof of marriage/relationship/bills are needed if filing under the 5-year rule.

My hubby applied under the 5 year rule, and there's far less scrutiny on the relationship.  They asked us for scans of proof my husband signed up for selective service, our wedding certificate, and his current greencard.  We also submitted his state ID.  None of it was asked for when he went in for the interview even though he did bring it.

I've heard some take some tax transcripts but it's not required.  You can always add them to be on the safe side if you are concerned about that.

If you're planning on submitting your application online, the system will tell you what all documents you'll need to upload based on your responses to the questions (copy of GC card, current marriage certificate, etc.). These are the only documents you'll have to upload with your submission. For your interview, plan on bringing:

  • The originals (or certified copies) of all the documents you uploaded when submitting your n-400
  • The interview letter will also specify some documents (Selective Services letter, passports, etc.), bring those along as well
  • Any other documents that may help further support your application (example: tax transcripts, utilities, mortgage/rental agreement, etc.). The interview officer may or may not ask for such documents, but it's better to play it safe. They have the right to review all the past immigration statuses at this time, so might as well be prepared!
