My sister in law and 2 nephews came to visit for summer vacation, had all information on place to stay, round trip ticket (showing returning after 6 weeks), previous travel history to US with no overstays.  CBP  in TX told her that it was too long for her to stay and only gave all three two weeks.  Going to CBP tomorrow locally (not in TX) to ask about stay length and to see if it can be changed.  Geesh!!!!!

A 6 month stay is never guaranteed at all. You can ask for a extension on their tourist visa that is it.

It cannot just be changed, but she can file an Extension of Status (EOS) application if necessary. Otherwise, there's not much to do.

 

Also have them check their I-94s online (https://i94.cbp.dhs.gov/I94/)...maybe the officer stamped it wrong but entered another date into the system, which is the actual determining factor.

This is actually their third time here on summer vacation for six weeks, they come every two years, and all three have ten year visas.  Each time they got 6 months, this is only time they ever POEd in TX.  Already checked I-94 it says two weeks, so my nephew has to return before his planned birthday party.

 

i have gone to local CBP office before for mother in law and they changed her dates without filing extension so will see for this issue.

It's absolutely normal to not get 6 months. Also warning - you keep running to cbp with complains and changing dates/extending and next time your family will be send back home and their b2 visas will be revoked. 

 

They keep coming to visit on long vacations and they will end up being denied entry also. 

 

Is it really worth it? The fact that they only got 3 weeks this time is a HUGE warning.

Ummmm 6 weeks out of 24 months is the purpose of the visa.  Several people from certain countries come multiple times a year with NO issues.  They even were issued 6 months when they came for a one week cruise.  They came and left after the cruise.

Some people come without issues some gets in troubles. 

 

Like I said, your family have been warned. Do whatever you want with that. If I were you I'd have them stay exactly the time they were allowed to show good faith.  Entry to the US is not a right. Only US citizen are guarantee entry.

To be fair, vacation policy in the US is very low compared to many other places. At my last non-US job I got 26 working days of leave a year (plus public holidays). A 6 week vacation is quite easy to take with that. 6 weeks over summer is also quite possible for teachers, etc.

Update:. Got a compromise change so they got 4 weeks.  My SIL had to pay 555.00 to change plane tickets which sucks.  So they decided they will still come in two years but will do a cruise, and will never POE in TX again.

In their country they get several weeks for vacation, because everyone takes a foreign vacation.  Most countries take their policies and procedures from British rules.  Also, the fact that they are out of school until Sept. So no issue with the kids.
