Timeline

We have a problem and I'm not sure where to go from here. Everything related to my husband becoming a permanent residence had been filed and completed with my husband receiving his Visa stamp in his passport on 05-17-2016, he entered the US on 05-25-2016. He received his SS card on 06-15-2016.

 

And that was it. We waited for his green card to arrive, and waited. We contacted USCIS who told us to “wait.” We would make another inquire every 3 months with the results being, “wait.” After countless appointments with USCIS in Phoenix, we were finally given a little hope in that they would try to look into the delay. A case inquiry was filed because the case was outside the normal processing time. 04-17-2017

 

On 04-05-2018 we were told everything had been lost and had to be resubmitted. At that time I had a second set of all documents I had submitted so I pulled it all together and sent it in. On 05-20-2018 his green card arrived, it would expire in 20 days. This all happening around the time we were supposed to be putting together our I-751, it was due 05-11-2018. An extension was issued by USCIS until 07-02-2018. That is the date my husband's passport expires.

 

We have sent his passport off to Canada to be renewed but do not have anything back as of yet. We have to file the I-751 and when we call USCIS they said we could submit an explanation of why we miss the date along with all the documents they request and see what they say. We can't submit the form until we have a current passport and we have no idea just when that will arrive.

 

The other thing is that if we go online to see where his green card is, we are told its still being reviewed and to wait. Just about everyone we talk to gives us a different explanation.

I would rather be hated for who I am, than loved for who I am not ...

New Canadian passport should arrive 4-6 weeks after it was received.

 

Filing I-751 a little late is okay with an explanation letter. Did you keep a photocopy of the old passport to show it was expiring the same day as the extension expiration? Also, did you keep copies of your passport renewal application and/or proof you mailed it to Canada? Including all this will help prove you had legitimate reasons to hold off the I-751.

 

Lastly, if he has his actual green card, it doesn't matter what it says online.
